<br />Kliever Lake Fields Third Addition <br />July 18, 2005 <br /> <br />Page 3 <br /> <br />Grading, Drainage and Utilities <br /> <br />Grading, Drainage and utility issues are addressed in the City Engineer's memo. <br /> <br />Landscaping <br /> <br />The landscaping plan submitted by the applicant meets the landscaping requirements. A <br />landscaped buffer of 14 Red Maples and 45 Black Hills Spruce is proposed along County <br />Road 12 and Fillmore Street. The remaining 62 overs tory trees, 44 spruce trees and 34 <br />ornamental trees are planted throughout the project. <br /> <br />Planning Commission Meeting <br /> <br />At the Planning Commission meeting held on June 28th, no one spoke at the public hearing. <br />The Commission asked for clarification regarding the location of the sidewalk, setbacks from <br />the drainage pond and County Road 12. The sidewalk will be on the north side of Street A, <br />the buildings will be setback 25 - 30 feet from the pond and 50 feet from County Road 12. <br /> <br />Recommendation <br /> <br />The Planning Commission and staff recommend that the City Council approve the <br />preliminary plat for Kliever Lakes Fields Third Addition with the following conditions: <br /> <br />1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED OUTLINING THE TERMS <br />AND CONDITIONS OF THE PLAT APPROVAL PRIOR TO RELEASING THE PLAT FOR <br />RECORDING. <br /> <br />2. SURFACE WATER MANAGEMENT FEE BE PAID IN THE AMOUNT REQUIRED BY THE CITY <br />AT THE TIME OF FINAL PLAT PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />3. THE CITY ENGINEER'S COMMENTS BE INCORPORATED INTO THE PLANS. <br /> <br />4. STREET LIGHTS BE INSTALLED AS REQUIRED BY ELK RIVER UTILITIES <br /> <br />5. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE <br />COSTS OF THE PUBLIC IMPROVEMENTS. <br /> <br />6. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED BY <br />THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE IMPROVEMENT <br />COSTS SHALL BE SUBMITTED TO THE CITY FOR THE PERIOD OF ONE YEAR. <br /> <br />7. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE PAID <br />PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />8. A GRADING AND EROSION CONTROL PLAN BE APPROVED BY THE CITY ENGINEER <br />PRIOR TO THE ISSUANCE OF BUILDING PERMITS. <br /> <br />9.
