City Council Minutes <br />April 20, 2020 <br />Page 6 <br />Mr. Roedel will speak to the Parks and Recreation Commission at their May 13, 2020 <br />meeting. <br />9.2 Nuisance Code: Semi -Tractors in Residential Area <br />Mr. Carlton presented the staff report. <br />The Council felt that a lot size of 2.5 acres was large enough for parking a semi and <br />that it should be determined by lot size and not by zoning district. <br />City Attorney Beck stated there was a reason that a zoning district stipulation was <br />put in place in the past due to complaints and reactions to various situations. <br />9.3 Building Code for Home -based Commercial in Residential Areas <br />Mr. Leeseberg presented the staff report. <br />Councilmember Christianson stated he didn't think there was a "one size fits all" <br />solution. <br />Councilmember Westgaard would like to get to the point of taking subjectivity out of <br />the decision. He suggested going back to the definition of home occupation and <br />differentiating intent. <br />Mr. Leeseberg stated there was a problem with some businesses opening in their <br />home vs commercial district because there were fewer regulations in a home <br />business. <br />Mayor Dietz asked if the city could set criteria for certain types of business or certain <br />sizes. <br />City Attorney Beck stated he would have to discuss the different types of "silos" the <br />city could put businesses in with the Fire Department and Building Official Bob <br />Ruprecht. There needs to be a rational basis for making these distinctions. <br />Councilmembers Ovall and Wagner were concerned about deterring home <br />businesses due to bureaucracy. <br />Mr. Leeseberg stated that staff didn't want to see changes. The point of having <br />restrictions for businesses was to protect the people in those buildings. <br />City Attorney Beck stated the building code is established for the public as a whole <br />and can't be ignored. Once the city determines to apply the building code, we need <br />to enforce them. <br />INATUREI <br />
