E. <br />425 Jackson A venue <br />Elk River, MN 55330 <br />(763) 241-7030. 800-594-5208 <br /> <br /> <br />Sherburne County <br />PUBLIC WORKS DEPARTMENT <br /> <br />July 1,2005 <br /> <br />City of Elk River <br />Attn: Terry Maurer <br />13065 Orono Parkway <br />Elk River, MN 55330 <br /> <br />JUl <br />() (J 200S <br /> <br />Dear Mr. Maurer: <br /> <br />As we discussed at our meeting June 26t\ the county is willing to move forward on <br />constructing County Highway 40 to the rural design standard if the City of Elk River can have <br />the required right-of-way(RIW Plat #30) acquired by the Federal deadline date of April 15th, <br />2006. <br /> <br />Also as we discussed, the county was asked by the city to acquire the necessary right-of-way <br />from Walter Malmstrom for the federal reconstruction project of CH 77 and CH33 from CSAH <br />1 to the US H wy 169 interchange with the understanding the City of Elk River will reimburse <br />us the cost of the appraisal, land acquisition and damages. This project requires right-of-way <br />from parcels in addition to the Malmstrom's. The County is moving ahead with this project <br />under the assumption that the City will reimburse the County for all of the parcels along this <br />project as was agreed with the Malmstrom property. If this is not the case, the City of Elk River <br />would be required to acquire the required right-of-way for this project as well by April 15th <br />2006. <br /> <br />I am asking that you please confirm that the city is agreeable to these conditions before any <br />further work goes into these projects. <br /> <br />If you have any questions or concerns, please do not hesitate to call me at (763)241-7030. <br /> <br />Sincerely, <br /> <br /> <br />Cc: Brian Bensen, Administrator <br />
