<br />VILLAGE OF ELK RIVER COUNCIL MEETING <br />March 11, 1938 <br /> <br />The special meeting of the Village Council was held at Hovey’s Café March 11, 1938 at 8 o’clock <br />P.M. <br /> <br />Members present: <br />Frank Nickerson, Pres.; G.A. Bailey, Geo Cornelius, Wm Patenaude, Trustees; <br />Wm H Greupner, Clerk. <br /> <br />The purpose of this meeting was to pass an ordinance No. 37 licensing pin ball machines. A motion <br />was made by G.A. Bailey seconded by Geo Cornelius to accept the following ordinance: <br /> <br />Ordinance No. 37 <br />The Council of the Village of Elk River do ordain: <br />Section 1 – Definitions. A game of skill shall include any device played by manipulating special <br />equipment and propelling balls across a board or field into respective positions whereby a score is <br />established the object of which is to secure a special number or numbers or a high total score which <br />may be played by the public generally at a price paid either directly or indirectly for such privilege. <br />Nothing in this ordinance shall be interpreted as permitting the operation of any game or device <br />constituting a lottery or gambling device and prohibited under the state law. <br /> <br />A lottery or gambling device shall man and include any plan, device or instrument for the <br />distribution of property by chance for which chance a consideration is paid. <br />Section 2 – License required. No person, firm or corporation shall operate or keep for operation any <br />game of skill without having applied for an received a license therefor from the Village Council as <br />herein provided. Application for such license shall be made to the Village Clerk upon a form to be <br />supplied by the Municipality and shall give the name and address of the applicant. The plan where <br />such game is to be operated, what business is conducted at that place, the name member and <br />description of the game and particular piece of equipment to be licensed, the fee for playing the <br />game and prize, if any and such other information as the Council may require. Every such <br />application shall be accompanied by an annual license fee of $50.00 for each machine, which shall be <br />paid into the general fund of the municipality. Such application shall be considered by the council at <br />its next regular meeting and granted or rejected. Licenses shall be for a term of one year. <br />Section 3 – License to be displayed. Every license granted hereunder shall be posted in a <br />conspicuous place on or near the game so licensed and shall identify the same by number or <br />description. <br />Section 4. Prohibited practices and restrictions – No license hereunder shall be issued for any game <br />of skill within 500 feet of any school building. No person shall use any device licensed under this <br />ordinance as a gambling device, and no licensee shall permit any person or persons to use any <br />machine licensed hereunder for gambling purposes, neither shall minors or school children be <br />permitted to use or play the same, and the operation of any lottery or gambling device is declared <br />contrary to this ordinance. <br />Section 5. Penalty. Any person violating the provisions of this ordinance shall be guilty of a <br />misdemeanor and upon conviction thereof shall be punished by a fine of not to exceed $100.00 or <br />by imprisonment for not more than ninety days. <br /> <br />
