Whereas, said Commissioner of Highways proposes to construct and improve said Trunk Highway <br />though said Village and has prepared plans for said construction and improvement a copy of said <br />plans are presented herewith and made a part of this resolution, and <br />Whereas, the construction and improvement of said Trunk Highway, Roadway or Structure, requires <br />a change in the grade of the streets in said Village along and upon which said Trunk Highway passes, <br />to provide greater width or capacity necessary for the accommodation of the Village and the <br />highway traffic; and <br />Whereas, it ahs been determined that said Trunk Highway be constructed and improved through <br />said Village in accordance with said plans and the standard Minnesota Highway Specifications and <br />upon the grade designated therein. Now, therefore: <br />Be it resolved, that said plans and specifications for the construction and improvement of said trunk <br />highways through said village be and the same hereby are approved: and <br />Be it further resolved, that said Village of Elk River, hereby consent to and approves the <br />construction of said roadway or structure to provide a greater width or capacity by changing the <br />grade of the streets along which said Trunk Highway passes as designated and shown in said plans <br />attached hereto and made a part hereof, for the accommodation of the Highway traffic and assumes <br />any and all liability and responsibility and agrees to pay for all damages resulting directly or indirectly <br />to the property abutting upon said proposed Trunk Highway No. 10 which has been included within <br />the right of way of said proposed Trunk Highway No. 10, that if any action or proceedings for <br />damages are commenced by any abutting owner by reason of the construction as improvement of <br />said Highways, the said Village of Elk River does hereby contract and agree to intervene and defend <br />such action or proceedings and pay any damages that may be awarded in favor of such abutting <br />owner, together with costs and disbursements of said action or proceedings and reasonable <br />attorney’s fees. <br />th <br />Dated at Elk River, Minnesota this 7 day of Sept 1937. A motion was made by G.A. Bailey <br />seconded by Geo Cornelius to accept this resolution. Upon roll call the following results – Geo <br />Cornelius, Wm Patenaude, G.A. Bailey, Wm Greupner, J.D. Flaherty – yes. Noes – non. <br /> <br />Henry Olson was present at this meeting and said the street light that was moved from the pole in <br />front of his house to the pole further down the street did not give enough light because it was set <br />amongst the branches of a tree and asked if the light could not be moved back to its original place. <br />Mr. Olson was told to see the property owners in that block and get their opinion as to what they <br />thought would be the best place for this light. <br /> <br />Donald Dare spoke about the water that stands in front of his house on the corner of Thomas and <br />Depot Streets and asked if the Village could put in a drain or a storm sewer. After a discussion the <br />clerk was told to see Mr. Middelstadt and get an estimate of the cost for a sewer at this place. <br /> <br />A motion was made by Wm Greupner seconded by Geo Cornelius to send a bill to the Village of <br />Dayton for $25.00 for the run that was made on Aug 17, 1937 when the Fire Dept was called the <br />second time to flood the basements of the houses that had burned down the previous evening. <br /> <br />A motion was made by G.A. Bailey seconded by Geo Cornelius to transfer $1500.00 from the Bond <br />and Interest fund to the sinking fund. Motion carried. <br /> <br />A motion was made by Wm H. Greupner seconded by Wm Patenaude to grant building permits to <br />Mr. Cox to build a coal shed and Wm Mansur to build a garage. Motion carried. <br /> <br /> <br />
