Request for Action <br /> <br /> <br />To Item Number <br />Mayor and City Council 7.1 <br />Agenda Section Meeting Date Prepared by <br />Public Hearings March 16, 2020 Chris Leeseberg, Senior Planner <br />Item Description Reviewed by <br />Interim Use Permit: Multi-Family Residential Use in Zack Carlton, Planning Manager <br />Single-Family Zoning District, Sogdiana LLC/Zafar <br />Reviewed by <br />Khamdamov, 732 Vernon Avenue <br />Cal Portner, City Administrator <br /> <br />Action Requested <br />Approve, by motion, the Interim Use Permit with the following <br />conditions: <br />1. The Interim Use shall terminate after 3 years (36 months) or <br />when the property changes ownership, whichever occurs first. <br />2. The Interim Use Permit will be recorded against the property <br />to put any future buyers on notice that the Interim Use <br />Permit will not run with property. <br />3. The structure shall be returned to a single-family home prior <br />to sale or when the Interim Use Permit terminates. <br />4. The applicant shall submit a deposit in the amount of $5,000 <br />to ensure compliance with the Interim Use Permit conditions. <br /> <br />Planning Commission <br />The majority of the Planning Commission had no concerns with the <br />request and believed it was the best solution for the applicant. <br /> <br />Two commissioners stated it was not the city’s responsibility to solve <br />the problem of a nonconforming use. <br /> <br />No one spoke for or against the request and staff has not received <br />any comments since the Planning Commission meeting. <br /> <br />The Planning Commission recommended approval of the request with a 3-2 vote. <br /> <br />Financial Impact <br />None <br /> <br />Statutory Review Period <br />Per State Statute §15.99, the required 60-day review period ends on April 12, 2020. <br /> <br />Attachments <br /> Planning Commission memo dated March 10, 2020 <br /> <br />The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional <br />service, and community engagement that encourages and inspires prosperity <br />
