7.0 Requirements and Procedure <br />A. Elk River Municipal Utilities will post and maintain a notice in appropriate and <br />conspicuous locations at its facilities that this policy has been adopted and that copies <br />are available for inspection at a specified location. <br />B. All personal injuries sustained while working for Elk River Municipal Utilities, and <br />all work-related accidents will be reported to an on-duty supervisor by the person <br />involved in the injury or accident and/or witness to the injury or accident. If no <br />supervisor is on duty at the time, one will be called at home. The notified supervisor <br />will then determine whether to request drug/alcohol testing of the injured person, the <br />person causing the injury, or the person involved or causing a work-related accident. <br />Any employee tested under this section of the policy may be suspended, pending <br />further investigation. <br />C. When a supervisor determines that an employee should be tested, the employee will <br />be told that in the supervisor’s opinion, the employee appears to be impaired and in a <br />state unfit to work. The employee may request another supervisor to be present <br />during the discussion. During this discussion, the employee shall be asked if he/she <br />has been drinking alcohol or has taken legal or illegal drugs. A written record of the <br />questions and the employee’s replies and actions will be maintained. <br />D. The employee has the right to refuse testing. Refusal will result in disciplinary action <br />taken against the employee. <br />E. In the event an employee agrees to testing, regardless of whether the employee admits <br />or denies taking legal or illegal drugs, the supervisor will explain that the employee <br />will be driven to the designated medical facility where the testing/screening will be <br />administered. The employee will NOT be allowed to drive to or from the designated <br />facility on his/her own accord. <br />8.0 Rights of Employees and Job Applicants to Refuse Testing <br />A. Applicants. IF a job applicant refuses to submit to an alcohol and/or drug test, any <br />offer of employment will be withdrawn and the individual will not be considered for <br />employment by Elk River Municipal Utilities. <br />B. Employees. Employees have the right to refuse to submit to alcohol and/or drug <br />testing. Employees or prospective employees, who refuse to provide a specimen, or <br />have adulterated a specimen, will be dismissed. <br />9.0 Employee/Job Applicant Rights After A Test <br />A. Within three (3) days after receiving notification of a positive test result, an individual <br />may submit any information to explain the result and request in writing a <br />confirmatory retest of the original sample at the employee’s or job applicant’s own <br />expense. <br />142
