<br /> <br /> 24 <br />January 2020 <br />If unanticipated, time-sensitive, or urgent work needs to be performed at times and/or <br />places outside of those scheduled by the Utilities, the non-exempt employee should <br />perform only so much of the work as is necessary to address the immediate need. <br />Regardless of whether work is anticipated or of an urgent nature, and regardless of whether <br />advance permission has been received to do such work or not, all time spent by a non- <br />exempt employee actually performing Utilities work must be accurately recorded and <br />properly reported to Utilities management. <br /> <br />Further to the Special Note above: <br />Working Remotely <br /> <br />Non-exempt employees who wish to work remotely (other than field employees whose <br />normal duties entail working away from the Utilities’ offices) must first obtain written <br />permission from management to do so. Employees may not access Utilities’ systems or <br />data without first obtaining such permission. <br />Any and all time worked remotely, including time spent accessing Utilities systems or data <br />for the benefit of the employer, must be recorded and reported to the Utilities in order to <br />assure proper compensation, in accordance with this Time Reporting Policy and the Fair <br />Pay Policy below in Section 26. <br /> <br /> <br />26. FAIR PAY POLICY <br /> <br />Elk River Municipal Utilities (referred to in this Fair Pay Policy as the “Employer” or the <br />“Utilities”) is committed to fair compensation for its employees as explained in this Fair <br />Pay Policy. Specifically, it is the policy and practice of the Employer to accurately <br />compensate employees and to do so in compliance with all applicable state and federal <br />laws. The Utilities will never knowingly fail or refuse to pay an employee the full amount <br />of compensation to which he or she is entitled by law for work performed on behalf of the <br />Utilities. <br />ALL EMPLOYEES <br /> <br />Protection of Employee Rights <br /> <br />The Employer will protect the right of each employee to receive compensation according <br />to the law. Violations of this Fair Pay Policy, whether by a managerial or non-managerial <br />employee, may result in disciplinary action, if appropriate under the circumstances, up to <br />and including termination of employment. <br /> <br />The Employer will not tolerate or allow any form of retaliation against individuals who <br />report alleged or suspected violations of this policy or who cooperate in the Employer’s <br />investigation of such reports. Retaliation is unacceptable, and any form of retaliation in <br />violation of this policy will result in disciplinary action, up to and including termination. <br />111
