<br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 92 - 19 <br /> <br />RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION OF NEGATIVE DECLARATION ON ENVIRONMENTAL <br />ASSESSMENT WORKSHEET FOR BARTON SAND AND GRAVEL COMPANY <br /> <br />WHEREAS, Barton Sand and Gravel Company supplied data to the <br />City of Elk River regarding a proposed mineral <br />excavation; and, <br /> <br />WHEREAS, Elk River City Staff and Consultants verified the data <br />and made conclusions as to the effects the proposed <br />project will have on the entironment; and, <br /> <br />WHEREAS, the City of Elk River as the Responsible Governmental <br />Unit (RGU) prepared an Environmental Assessment <br />Worksheet (EAW); and, <br /> <br />WHEREAS, the EAW was published on February 3, 1992 in the <br />Environmental Quality Boatd Monitor, a press release <br />was given to the Elk River Star News on January 29, <br />1992, and copies of the EAw were supplied to agencies <br />on the Minnesota Envirombent Quality Boards EAW <br />distribution list; and, <br /> <br />WHEREAS, the 30 day comment period eXpired on March 4, 1992 and <br />responses on the EAW from the Minnesota Pollution <br />Control Agency, the Department of Natural Resources, <br />and the Minnesota Historical Society indicated that an <br />Environmental Impact Statement (EIS) is not warranted; and, <br /> <br />WHEREAS, the City of Elk River Administers Mineral Excavations <br />by a conditional use permit and license process <br />through which environmental effects are anticipated <br />and conditions are placed on the operation to control <br />said effects; and, <br /> <br />WHEREAS, said conditional use permit is reviewed every two <br />years and said license is renewed yearly, and <br />therefore, mitigation of environmental effects is <br />ongoing; and, <br /> <br />WHEREAS, the type of environmental effects anticipated to be <br />possible with this proposal would be localized and <br />easily reversible through proper enforcement of said <br />conditional use permit and license; and, <br /> <br />WHEREAS, approval of this proposed mineral excavation is <br />subject to the findings of an area wide planning <br />effort on mineral excavation proposed to be conducted <br />by the City of Elk River; and, <br />
