<br />2. <br /> <br /> <br />e <br /> <br />WHEREAS, the Elk River Planning Commission held a public hearing on <br />the revised site plan on October 19, 1993, at which time <br />the Planning Commission heard a presentation on the <br />Project and received testimony from all those present who <br />asked to speak on the matter; and <br /> <br />WHEREAS, the Planning Commission, at its meeting on October 19, <br />1993, recommended approval of the Conditional Use Permit <br />and Preliminary Plat subject to a number of conditions; <br />and <br /> <br />WHEREAS, the City Council held a public hearing on the application <br />for a Conditional Use Permit and Preliminary Plat on <br />October 26, 1993, at which time the City Council heard a <br />presentation on the project and took testimony from all <br />those present who asked to speak on the matter; and <br /> <br />WHEREAS, the City Council also received a number of written <br />comments on the Project both before and at the public <br />hearing held on October 26, 1993; and <br /> <br />WHEREAS, the City Council, at the close of the public hearing on <br />October 26, 1993, identified a number of concerns and <br />issues with the proposed project; and <br /> <br />e <br /> <br />WHEREAS, the City Council, following the public hearing and Council <br />discussion of the Project on October 26, 1993, adopted <br />motions denying the Conditional Use Permit and Preliminary <br />Plat for Elk Park Center; and <br /> <br />WHEREAS, the motions to deny were subsequently amended by separate <br />motions of the City Council on October 26, 1993, which <br />motions rescinded the denials of the Conditional Use <br />Permit and Preliminary Plat and directed City staff to <br />prepare Findings of Fact in a Resolution of Denial of the <br />Conditional Use Permit and Preliminary Plat, for <br />consideration by the City Council on November 15, 1993; <br />and <br /> <br />WHEREAS, City staff subsequently prepared a proposed "Resolution <br />Making Findings of Fact Regarding the Elk Park Center <br />Proposal and Denying a Conditional Use Permit and <br />Preliminary Plat Approval for Elk Park Center" for <br />consideration by the City Council, which resolution <br />identified 12 reasons for denial of the Conditional Use <br />Permit and Preliminary Plat; and <br /> <br />WHEREAS, the City Council reviewed and considered the proposed <br />Resolution for Denial at its regularly scheduled meeting <br />of November 15, 1993 and took the following actions: <br /> <br />o <br /> <br />The Council amended Section C.3. of the proposed <br />Resolution of Denial regarding enclosure of the <br />holding ponding area; <br /> <br />e <br />
