<br /> <br />-- <br /> <br />e <br /> <br />e <br /> <br />CITY OF ELK RIVER <br />RESOLUTION NO. 94 - 2! <br /> <br />A RESOLUTION AMENDING THE COMPREHENSIVE PLAN <br />TO CHANGE THE LAND USE <br />FROM <br />MR (MEDIUM DENSITY RESIDENTIAL) <br />TO <br />HB (HIGHWAY BUSINESS), CITY OF ELK RIVER <br />CASE NO. LUA 94-04 <br /> <br />WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, <br />prescribes the procedure for amending the Comprehensive Plan, and <br /> <br />WHEREAS, the Planning Commission held a public hearing on June 21, <br />1994, and recommended approval regarding the Comprehensive Plan <br />amendment request for the property legally described as: <br /> <br />That part of the south 928.55 ft. of the SW 1/4 of the NE 1/4 Section 27, <br />Township 33, Range 26, Sherburne County, MN, lying west of Hillside Estates <br />1st Addition and lying east of Highway 169. Parcel of land lying north of above <br />mentioned legal description, extending easterly line of above mentioned legal <br />description 50 ft. from that point westerly to a point lying northerly of west line <br />of above mentioned legal description extended 100 ft. containing 1.07 acres plus <br />or minus, <br /> <br />from R1E (Single Family Residential) to PUD (Planned Unit Development) based <br />on the following findings: <br /> <br />1. The land use plan amendment is consistent with the City's Growth <br />Management Plan, which identifies Highway 169 as the commercial <br />corridor. <br /> <br />2. The amendment is a minor extension to the existing commercial land use <br />and will not compromise the integrity of Highway 169 or surrounding <br />properties. <br /> <br />and, <br /> <br />
