<br />Request for Action <br /> <br /> <br />To Item Number <br />Mayor and Council Members 4.3 <br />Agenda Section Meeting Date Prepared by <br />Consent December 2, 2019 Mark Dickinson, Fire Chief <br />Item Description Reviewed by <br />Amend Rental Dwelling Ordinance Peter Beck, City Attorney <br />Reviewed by <br />Cal Portner, City Administrator <br /> <br />Action Requested <br />Amend by motion, Article III, Division 3, Section 30-192 (b) (9) of the City of Elk River’s ‘Residential <br />Rental Property Standards’ to eliminate redundancy between the City and the Landlord. <br /> <br />Background/Discussion <br />In the past, all Rental License applications included a copy of the EPA Lead Disclosure and the Crime <br />Free Drug Free Housing addendum. This activity was a duplication of effort between the city and the <br />landlord. <br /> <br />The Attorney General’s publication ‘Landlords & Tenants - Rights &Responsibilities,’ spells out the rights and <br />duties of landlords and tenants in the state. Minnesota Statutes § 504B.181, subd. 2(b), requires landlords <br />to notify/provide tenants with the above addendums.
