MITCHELL -� Notary PubNc-Minnesota " 2020 MY Commission Expires Jan 31, Rate Information: (1) Lowest classified rate paid by commercial users for comparable space: $23.00 per column inch CITY OF ELK RIVER RESOLUTION 19-53 A RESOLUTION OF THE CITY OF ELK RIVER APPROVING NOTICE OF SUMMARY PUBLICATION OF ORDINANCE #19-19 AN ORDINANCE GRANTING A FRANCHISE TO SPECTRUM MID-AMERICA LLC D/B/A CHARTER COMMUNICATIONS Councilmember Wagner intro- duced the following resolution and moved its adoption: WHEREAS, on February 4, 2019, the Elk River City Council adopted Ordinance 19-02 repeal- ing and replacing an ordinance ti- tled the "Cable Ordinance" which established regulations governing cable service; and WHEREAS, the City Council adopted a lengthy ordinance grant- ing a 15-year renewal of the cable franchise to Spectrum Mid -Ameri- ca LLC d/b/a Charter Communica- tions which authorizes operation of a cable system and delivery of ca- ble services in the city pursuant to the Cable Ordinance; and WHEREAS, as authorized by Minnesota Statutes, Section 412.191, subd. 4, the City Council has determined that publication of the title and summary of the ordi- nance will clearly inform the public of the intent and effect of the ordi- nances; and WHEREAS, a copy of the full text of the ordinance is available for inspection by any person at the office of the Elk River City Clerk, 13065 Orono Parkway, during reg- ular business hours; and NOW, THEREFORE, BE IT RE- SOLVED by the City Council, by at least four -fifths vote, authorizes the publication of the title and summa- ry of Ordinance 19-19. The motion for adoption of the foregoing resolution was duly sec- onded by Councilmember Ovall, and upon vote being taken thereon, the following voted in favor there- of: Mayor Dietz. Councilmembers Chris' nson. Wesigaard. Ovall. and Wagner and the following against: none, whereupon said res- olution was declared duly passed and adopted. The following members were present: Mayor Dietz, Coun- cilmembers Christianson, West- gaard. Ovall. and Wagner and the following absent: none. Passed and adopted this 4th day of November 2019.
