The Comprehensive Plan guides this area as Mixed Use which allows a mixture of housing, jobs and/or <br />retail services uses within close proximity to each other. The area also provides another setting for high <br />density residential land uses. The proposed use and rezoning to a residential PUD is supported by the <br />Comprehensive Plan and is similar to surrounding land uses. <br /> <br />Site Plan <br />rd <br />The site lays out with a single driveway entrance on 183 Ave. NW leading to a central parking/drive area <br />with all four duplex buildings facing the center of the parking area. The parking/drive area will be <br />privately owned and maintained. <br /> <br />Townhome standards require one-half guest parking space per unit in an off-street parking lot or private <br />drive. The site plan identifies 12 off-street parking stalls on the site, which satisfies the ordinance <br />standards. Each home also has a two-stall garage. <br /> <br />A drainage pond is located on the southeast corner of the site in an existing drainage and utility easement. <br />Previous approvals indicate the easement was set aside for stormwater management and the proposed use <br />is allowed in the easement. The stormwater pond functions as a dry infiltration pond, doesn’t hold water, <br />and does not trigger the 45 foot setback and buffer requirements. <br /> <br />Engineering and Utilities <br />The property is graded to direct runoff to the perimeter of the site which is then directed to swales and <br />ultimately to the stormwater pond. <br /> <br />All homes will be served by city sewer and water. <br /> <br />Landscaping <br />City ordinances require 33 trees to be planted on the property. The property has numerous mature trees <br />on the site today. Once the construction limits have been finalized, staff will review the site with the <br />applicant to calculate the number of trees, if any, that must be planted to meet city ordinances. <br /> <br />Applicable Regulations <br />Zone Change <br />In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directly and indirectly <br />affected by the proposal, the conservation of property values, the use to which the property affected is being devoted at the time, <br />and relevant provisions, if any, in the land use plan. <br /> <br />The proposed use complies with the guidance provided in the land use plan. <br /> <br />Conditional Use Permit/PUD <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br /> <br />1. Will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or <br />the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city. <br />The residential use will not detrimentally affect the use and enjoyment of adjacent properties. <br />However, the residents of the future townhomes may be impacted by the existing business and <br />residential uses in the area. <br /> <br />2.
