4. The plight of the petitioner is due to circumstances unique to the property not a consequence of <br />the petitioner's own action or inaction; and <br />Due to the slope of the land and existing house location, this leaves the only practical location to build. <br /> <br />The applicant stated they need the amount of space proposed to operate on their commercial lot. <br />With the dramatic elevation change on the property, the proposed location appears to be the <br />soundest. <br /> <br />The plight of the petitioner is due to circumstances unique to the property and is not a <br />consequence of the petition's own action or inaction. <br /> <br />5. The variance, if granted, will not alter the essential character of the locality. <br />If the variance is granted, this will not alter the locality but only improve it. With the new addition, the existing <br />house will be refaced with versetta stone as well as many more alterations to the landscaping that will not only <br />improve the property but help with road side appeal off of US169. <br /> <br />The locale is comprised of industrial and off-road racing uses.
