H. The proposed vacation shall not be recorded with Sherburne County until after <br />City Council approval of a boundary line adjustment that places the septic <br />system and shed on the same parcel as the home at 13008 Island View Drive. <br />DECISION <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />River, Minnesota, as follows: <br />1. The Right -of -Way legally described on the attached Exhibit 1 is hereby <br />vacated contingent upon the Closing of the Property at 13008 Island View <br />Drive. The vacation shall not affect existing easements for utilities therein. <br />2. The City Clerk is hereby directed to file a certified copy of this Resolution <br />with the County Auditor and the County Record/Registrar of Titles in <br />accordance with the terms of this Resolution. <br />Passed and adopted this 15th day of July 2019. <br />ATTEST: <br />Tina Allard, City Clerk <br />John J.
