Yunker <br /> <br />______________________________________________________________________________ <br /> <br />CONTINGENT SETTLEMENT AGREEMENT <br />______________________________________________________________________________ <br /> <br />RECITALS <br /> <br /> WHEREAS, on December 19, 2017, Plaintiffs John and Elaine Dryer (referred to <br />hereinafter alternatively as “Plaintiffs” or “Dryers”) initiated the above -captioned lawsuit, Case <br />File No. 71-CV-18-705 (hereinafter “Lawsuit”) against Defendants City of Elk River (hereinafter <br />“City”) and SN L Island View Properties, LLC (hereinafter “SNL”); and <br /> WHEREAS, the Dryers own a single-family home at 13008 Island View Drive, Elk River, <br />Minnesota and legally described as: Lot 14, Block 1, Island View Subdivision (“Property”); and <br />WHEREAS, the plat for Island View Subdivision (“Island View Plat”) was approved by <br />the Sherburne County Board of Commissioners on July 12, 1961; and <br /> WHEREAS, Island View Subdivision is bordered to the east by Westwood Subdivision; <br />and <br /> WHEREAS, the Plat for Westwood Subdivision (“Westwood Plat”) was approved by the <br />Sherburne County Board of Commissioners on February 4, 1953; and
