Board of Adjustments Minutes Page 3 <br />May 28, 2019 <br />----------------------------- <br /> <br />Commissioner Larson-Vito explained her concerns about the reasons for having <br />setbacks, and having flammable grills being close to neighboring structures. She <br />stated her initial thought is to deny the request, noting there seems to be more <br />options available and didn’t feel this was unique to the property. She also indicated <br />concerns with setting precedence. <br /> <br />Commissioner Thiel stated he supports a denial as well, noting the commission has <br />denied similar requests in the past and had concerns with setting precedence. <br /> <br />Chair Johnson stated he agreed with the others and noted in order to approve the <br />variance, the five criteria would have to be met. <br /> <br />Moved by Commissioner Larson-Vito and seconded by Commissioner <br />Feinstein to deny the variance request by Scott Lillestrand for a 2.5’ side yard <br />setback to construct a deck as the following standard, required for approval of <br />a variance, is not satisfied: <br /> <br />4. The plight of the petitioner is due to circumstances unique to the <br /> property not a consequence of the petitioners own action or inaction. <br /> <br />Motion carried 5-0. <br /> <br />Mr. Leeseberg stated because of the denial, the City Council will automatically review <br />this variance denial at their June 17, 2019, meeting. <br /> <br />6.
