The Development Plan shall <br />include such information as staff shall direct. <br />(04) Storm Sewer - Drainage and storm sewer design for the <br />Subdivision must be approved by the City Engineer prior to <br />recording of final plat. <br />(05) Trees removed during construction of roads and houses <br />shall have their stumps removed within 24 hours or have <br />their roots severed from adjacent trees prior to removal. <br />Root severing must be done to a depth of five feet. <br />Exposed roots must be buried the same day as removal. The <br />drip line of trees remaining after construction must be <br />roped off to define an area of no activity to protect the <br />trees from mechanical damage. <br />(06) The temporary cul-de-sac must be extended to the <br />north end of Lot 4 and made full size. That portion of the <br />cul-de-sac that falls outside of the 60 foot right-of-way <br />must be secured by temporary easements that are <br />automatically released when the road is extended. <br />(07) The drainage and utility easements that extend north <br />and east from the right-of-way in the Subdivision must also <br />be dedicated through easement documents to the City for <br />roadway purposes. <br />(08) Developer shall pay the City for first sealcoating of <br />streets in the Subdivision in the amount of $2,511.00, <br />prior to recording of the final plat. <br />(09) Developer shall install street lights as directed by <br />the Elk River Public Utilities. <br />7.) General Provisions - <br />(01) Building and Occu anct- Permits - If the Developer fails <br />to comply with any of the provisions hereof, the City may <br />refuse to issue a building permit or certificate of occupancy <br />for any lot or parcel in the Subdivision. City will not issue <br />any building permit for any lot or parcel in the subdivision <br />until all roads are graded and gravel subbase and base have <br />been installed and approved by the City Engineer and roads are <br />ready for bituminous surfacing. City will not issue any <br />Certificate of Occupancy for any building constructed on any <br />lot or parcel in the Subdivision until all Improvements are <br />completed and approved by the City Engineer and/or the City <br />Building and Zoning Administrator, except that a Certificate <br />of Occupancy can be issued before bituminous surfacing of <br />roads, if such surfacing is not possible because of weather <br />conditions. Developer agrees to advise purchasers of any lot <br />or parcel within the Subdivision of the existence of this <br />Contract and the obligations and restrictions created herein <br />prior to the completion of a sale.
