River <br />Request for Action <br />To <br />Item Number <br />Planning Commission <br />4.8 <br />Agenda Section <br />Meeting Date <br />Prepared by <br />Public Hearings <br />May 28, 2019 <br />Chris Leeseber , Senior Planner <br />Item Description <br />Reviewed by <br />Ordinance Amendment - Institutional Uses, Case <br />Zack Carlton, Planning Manager <br />No. OA 19-04 <br />Reviewed by <br />Action Requested <br />Recommend, by motion, approval of the ordinance amendment, including proposed definitions and the <br />various permitted vs. conditional uses, as outlined. <br />Background/Discussion <br />On February 19, 2019, City Council directed staff to review the definitions for institutional uses, separate <br />the various uses from the current definition, and review acceptable locations for all of these uses. <br />The Planning Commission reviewed staffs' first draft of the definitions and locations at their April 23, <br />2019, meeting and provided staff with the following recommendations: <br />■ Dividing bealtb care facility, inpatient into two parts: assisted living/nursing home type facilities and <br />hospitals. <br />■ Allow assisted living/nursing home type facilities in high density residential districts but not <br />hospitals. <br />■ Keep educational uses in residential areas and not allow in commercial/industrial districts. <br />■ Allow residential facilities as a permitted use if housing 1-6 beds and as a conditional use for <br />housing 7-16 beds. <br />■ Include language to support religious institutions as a secondary/accessory use to permitted or <br />conditional uses in commercial districts. <br />o The three commercial districts would be amended to allow religious institutions as an <br />accessory use with the following limitations: worship services shall be limited to two days a <br />week, the structure shall meet building codes for religious institutions, and parking stalls must <br />be verified by city staff. <br />The attached spreadsheet outlines proposed locations of the various uses and what process each <br />location/use would require, such as permitted vs. conditional uses. <br />Financial Impact <br />None <br />Attachments <br />Proposed Definitions <br />Proposed Locations <br />The Elk River Vision <br />A n.,elcoming community n itb revolutionary and spirited resourcefulness, exceptional P o N E 8 E o e r <br />service, and community engagement that encourages and inspires prosperity [NAWR <br />� <br />
