DBA Guardian Angels By The <br />Zack Carlton, Planning Manager <br />Lake — 13439 195th Lane NW <br />Reviewed by <br />■ PUD Amendment to Allow a Bus Garage, Case <br />No. CU 19-07 <br />Action Requested <br />Recommend, by motion, approval of a Conditional Use Permit <br />authorizing an amendment to the approved site plan as the <br />standards set forth in Section 30-654 have been satisfied. <br />Background/Discussion <br />The property is zoned PUD where changes to the approved site <br />plan require a Conditional Use Permit (CUP). <br />The applicant is seeking a CUP to amend the previously approved <br />Planned Unit Development agreement, originally approved in 1997, <br />to construct a 450 square foot detached accessory structure. In <br />2003 the applicant received a CUP to construct a 576 square foot <br />accessory structure, and in 2011 they received a CUP to construct <br />30 memory care and assisted living units. <br />The proposed location is adjacent to the existing accessory <br />structure, is open and relatively flat, and is screened from view to <br />the residential homes west of the subject parcel. <br />Applicable Regulation <br />In approving a Conditional Use Permit, the council may impose <br />such specific conditions with regard to the development or <br />operation of the proposed use as it considers necessary to satisfy Figure i <br />the seven standards set forth in Section 30-654 and the requirements contained in this article and to <br />promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the <br />neighborhood or the city. <br />The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: <br />7. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or <br />the public health, safety, morals, comfort, convenience orgeneral n elfare of the neighborhood or the city. <br />The Elk River Vision <br />A n.,elcoming community nvith revolutionary and spirited resourcefulness, exceptional p o w E n E o e r <br />service, and community engagement that encourages and inspires prosperity [NAWR <br />� <br />
