City Council Minutes <br />May 20, 2019 <br />Page 4 <br />Mayor Dietz opened the public hearing. There being no one to speak to this issue, <br />Mayor Dietz closed the public hearing. <br />Councilmember Ovall stated the planning commission was divided on how to handle <br />home occupations. He stated this ordinance respects the rights of the land owner <br />and would be complaint driven. He stated it will be interesting to see if more <br />conditional use permits occur as a result of the changes. <br />Moved by Councilmember Christianson and seconded by Councilmember <br />Ovall to adopt Ordinance 19-11 amending Chapter 30-801, home occupations <br />of the City of El River, Minnesota, City Code. Motion carried 4-0. <br />8.1 Concept Review: Planned Unit Development Amendment at Elk <br />Ridge Center to Allow an Apartment Building <br />Mr. Carlton presented the staff report. <br />Andrew Hughes, Director of Acquisition and Development for CommonBond <br />Communities discussed the proposed project as outlined in his presentation. <br />Council questioned the Maxfield Study and where the city is at with low rent <br />housing. <br />Mr. Carlton stated there is still a need for 77 units and this project would add 60 <br />units. <br />Council noted the following: <br />■ This property has been difficult to market over many years. <br />■ It would be difficult to hold the current property owner hostage for four years to <br />wait for the 169 Redefine project. <br />• Property doesn't have highway visibility and not desirable for other retail <br />opportunities. <br />■ Due to the location, there would be signage issues for the retail market. <br />■ Project would be a good fit for a transition between residential and commercial <br />districts. <br />■ CommonBond would be expected to meet the design standards as was required <br />by the other businesses in this development. <br />Attorney Beck stated this property must comply with the design standards outlined <br />in city code. He noted the resolution supports CommonBond's application to the <br />State but doesn't bind the Council to approving the project in the future. He stated a <br />Comprehensive Plan amendment will be required and four votes of the Council <br />would be required. <br />Moved by Councilmember Westgaard and seconded by Councilmember <br />Christianson to adopt Resolution 19-15 supporting the tax credit application <br />for proposed CommonBond Multiple Family Housing Project and <br />
