W WASTE MANAGEMENT 3.25 Publicity. 3.25.1 Except as may be required by law or governmental rules or the requirements of any exchange on which securities of Contractor or an affiliate of Contractor are traded, Contractor shall not,without the prior written consent of Owner, which may be granted or withheld at Owner's sole discretion: 1 use Owner's name, brand, trademarks or any descriptions of Owner and/or its industry that would allow a third party to identify Owner ("Owner's Brand"), in advertising or promotional material, publicity releases or for any other commercial purpose; .2 in any manner advertise, publish or disclose the fact that Owner has placed this Agreement with Contractor; .3 publish or provide for publication any information (including photographs)associated with the Work; or .4 disclose the subject matter or terms and conditions of this Agreement. 3.25.2 Contractor shall comply with the restrictions accompanying Owner's consent to any publicity related to the Work or Project, including but not limited to scope and term limitations. Unless otherwise specified by Owner in writing, Owner consents shall be deemed to be "initial use only," and will expire immediately after Contractor's first use of Owner's Brand as set forth in the applicable Owner consent. Any and all subsequent uses, including but not limited to re- publication of advertising or promotional material, duplicate or follow-up press releases or like publications shall each require an updated consent, duly executed by the Owner. In no case shall Contractor or an affiliate of Contractor use Owner's Brand or information about Owner's industry, equipment or operations in a manner that disparages Owner. 3.26 Job Progress Meetings 3.26.1 Contractor's Authorized Representative shall attend all job progress meetings scheduled by Owner. At such meeting, Contractor shall present any schedule updates or revisions required hereunder and, unless waived by Owner, a Contractor's status report. The status report shall include at least the following information and data, unless otherwise agreed by Owner: .1 major Work tasks accomplished in previous period (tasks started and completed); .2 major Work tasks planned in next period (tasks to start or be completed) .3 Problems encountered; .4 Requested owner assistance to resolve any problems and actions being taken by Contractor; .5 Construction Schedule progress, planned Construction Schedule revisions and status of any milestones; .6 Status of critical path for completion of the Work and items on the critical path; .7 If the Work involves Unit Prices, quantities installed to-date, forecast to-go and total; .8 For any Work being performed on a cost reimbursable basis, actual cost to-date and forecasted cost to complete; .9 Status of any open safety issues; and .10 Status of any open value engineering proposals. ARTICLE 4 Administration of the Agreement 4.1 Agreement Administration 4.1.1 The Owner's Authorized Representative will provide administration of the Agreement as described in the Contract Documents, and will be Owner's representative during performance of the Work and subsequent warranty period. 4.1.2 The Owner's Authorized Representative and his delegates will not have control over or charge of, and will not be responsible for, construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the Work, since these are solely Contractor's responsibility, as provided in Article 3.
