02/20/19 REVISOR RSI/SL 19-3503 as introduced <br /> 9.1 consumer-owned utility and designed to turn off,limit,or vary the delivery of energy,is <br /> 9.2 the exclusive property of the building owner,except to the extent that the improvement is <br /> 9.3 subject to a security interest in favor of the utility in case of a loan to the building owner. <br /> 9.4 The utility has no liability for loss,damage,or injury caused directly or indirectly by an <br /> 9.5 energy conservation improvement,except for negligence by the utility in purchase, <br /> 9.6 installation,or modification of the product. <br /> 9.7 Subd. 8.Criteria for efficient electrification or conversion improvements and load <br /> 9.8 management.(a)Each consumer-owned utility subject to this section may form a technical <br /> 9.9 consumer-owned utility working group to define and establish proposed programs for <br /> 9.10 efficient electrification or conversion improvements and load management.A proposed <br /> 9.11 program may be included in an energy conservation and optimization plan filed by the <br /> 9.12 consumer-owned utility under subdivision 4.The technical consumer-owned utility working <br /> 9.13 group may approve a proposed program for efficient electrification or conversion <br /> 9.14 improvements if it finds the investment is cost-effective after considering the costs and <br /> 9.15 benefits of the proposed investment to rate payers,the utility,participants,and society. <br /> 9.16 (b)The commission may permit a consumer-owned utility subject to rate regulation to <br /> 9.17 file rate schedules providing for annual recovery of the costs of(1)efficient electrification <br /> 9.18 or conversion improvement programs,and(2)cost-effective load management approved <br /> 9.19 by the technical consumer-owned utility working group under subdivision 6,including <br /> 9.20 reasonable and prudent costs associated with promoting and implementing a program <br /> 9.21 approved under this subdivision. <br /> 9.22 (c)An efficient electrification or conversion improvement is deemed efficient if the <br /> 9.23 technical consumer-owned utility working group finds the improvement,relative to the fuel <br /> 9.24 that is being displaced: <br /> 9.25 (1)results in a net reduction in the cost and amount of source energy consumed for a <br /> 9.26 particular use,measured on a fuel-neutral basis; <br /> 9.27 (2)results in a net reduction of statewide greenhouse gas emissions,as defined in section <br /> 9.28 216H.01,subdivision 2,over the lifetime of the improvement.For an efficient electrification <br /> 9.29 or conversion improvement installed by an electric utility,the reduction in emissions must <br /> 9.30 be measured based on the emissions profile of the utility or the utility's wholesale provider. <br /> 9.31 Where applicable,the emissions profile used must be the most recent resource plan accepted <br /> 9.32 by the commission under section 216B.2422; <br /> 9.33 (3)is cost-effective from a societal perspective,considering the costs associated with <br /> 9.34 both the fuel used in the past and the fuel used in the future;and <br /> Article 3 Section 1. 9 <br /> 107 <br />
