<br />~1~ <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Planning Commission Minutes <br />April 22, 2003 <br />Page 2 <br /> <br />Staff recommends approval of the requests with the findings and conditions as listed in the <br />staff report. <br /> <br />Chair Pederson opened the public hearing. There being no public comment, Chair Pederson <br />closed the public hearing. <br /> <br />Commissioner Lemke asked why MN/DOT needs to approve the conditional use pennit. <br />Mr. RoWf explained that outside sales will not be allowed until approval from MN/DOT is <br />obtained. <br /> <br />Discussion followed regarding approval of the applications with wetland delineation being <br />incomplete. Mr. Rohlf stated that he was in agreement with this policy, but in this case, he <br />did not feel a pwpose would be served by holding up the approval because of the wetland <br />delineation. He stated that he has visited the site and he does not feel that the wetlands will <br />be impacted by the request. <br /> <br />COMMISSIONER FRANZ MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY SCHMIDT GRAVEL MINING FORA REZONING OF <br />CERTAIN PROPERTY TO MINERAL EXCAVATION, CASE NO. ZC 03-01. <br />COMMISSIONER JENSON SECONDED THE MOTION. THE MOTION <br />CARRIED 7-0. <br /> <br />COMMISSIONER FRANZ MOVED TO RECOMMEND APPROVAL OF THE <br />REQUEST BY SCHMIDT GRAVEL MINING FORA CONDITIONAL USE <br />PERMIT FOR MINERAL EXTRACTION, CASE NO. CU 03-02, WITH THE <br />CONDITIONS OUTLINED IN STAFF'S REPORT DATED APRIL 22,2003, <br />WITH THE FOLLOWING ADDITIONAL CONDITION: <br /> <br />"ANY ITEM OR CONDITION FOUND THAT INDICATES THE SITE IS <br />LIKELY TO YIELD INFORMATION IMPORTANT TO PRE-HISTORY OR <br />HISTORY SHALL BE REPORTED TO THE CITY IMMEDIATELY. <br />FURTHER, THE CITY RESERVES THE RIGHT TO STOP WORK <br />AUTHORIZED IN ITS APPROVAL UNTIL THE SITE IS APPROPRIATELY <br />INVESTIGATED AND WORK IS AUTHORIZED TO CONTINUE BY THE <br />CITY." <br /> <br />COMMISSIONER JENSON SECONDED THE MOTION. THE MOTION <br />CARRIED 7-0. <br /> <br />5.3. Request by James and Stephanie Zaczkowski for Preliminary Plat Approval (Kingdom <br />Estates). Public Hearing - Case No. P 03-02 <br /> <br />Planner Chris Leeseberg explained that staff recommends that this request be tabled until <br />the May 27, 2003 Planning Commission meeting. <br /> <br />COMMISSIONER ANDERSON MOVED TO CONTINUE THE REQUEST BY <br />JAMES AND STEPHANIE ZACZKOWSKI FOR PRELIMINARY PIAT <br />APPROVAL (KINGDOM ESTATES), CASE NO. P 03-02, TO THE MAY 27,2003 <br />PlANNING COMMISSION MEETING. COMMISSIONER ROPP SECONDED <br />THE MOTION. THE MOTION CARRIED 7-0. <br />
