<br />Planning Commission Minutes <br />January 23.2001 <br />Page 17 <br /> <br />. <br /> <br />The Commission accepts the narrative and drawings submitted by the applicant <br />as the architectural theme. <br /> <br />Mr. Glines stated that they are interested in going beyond what was done in <br />Windsor Park regarding house designs, such as variable front setbacks, in creating <br />streetscapes. <br /> <br />Commissioner Baker noted that if the developer wishes to go above and beyond <br />what has been accepted in the narrative and drawings, the Commission would <br />support that effort. <br /> <br />Chair Mesich expressed his concern that density bonuses are being given for <br />wetlands that couldn't have been built on anyway. He felt it was important the <br />Commission review this issue at a future meeting. <br /> <br />Mr. Brown stated that he felt it was important to note that there is no infringement <br />upon the wetlands and that a large amount of dry land is being preserved that is <br />currently being farmed. <br /> <br />COMMISSIONER CHAMBERS MOVED TO RECOMMEND APPROVAL OF THE REQUEST <br />BY DYNAMICS DESIGN AND LAND COMPANY FOR PRELIMINARY PLAT APPROVAL <br />OF RIDGES OF RICE LAKE, CASE NO. P 01-02, WITH THE FOLLOWING CONDITIONS: <br /> <br /> 1. A DEVELOPERS AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE <br /> PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS BE PREPARED AND <br />. EXECUTED PRIOR TO RELEASING THE PLAT FOR RECORDING. <br />2. ALL COMMENTS OF THE CITY ENGINEER BE SHALL BE ADDRESSED. <br /> 3. A HOMEOWNERS ASSOCIATION DOCUMENT BE PREPARED SUBJECT TO THE CITY <br /> ATTORNEY'S REVIEW AND APPROVAL PRIOR TO FINAL PLAT. <br /> 4. STREET LIGHTS BE INSTALLED AS REQUIRED BY ELK RIVER UTILITIES <br /> 5. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE AMOUNT OF 100% OF THE <br /> COSTS OF THE PUBLIC IMPROVEMENTS. <br /> 6. UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING THEM ACCEPTED <br /> BY THE CITY, A WARRANTY BOND IN THE AMOUNT OF 25% OF THE <br /> IMPROVEMENT COSTS SHALL BE SUBMITTED TO THE CITY FOR THE PERIOD OF ONE <br /> YEAR. <br /> 7. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY AT <br /> THE TIME OF FINAL PLAT BE PAID PRIOR TO RELEASING THE PLAT FOR <br /> RECORDING. <br /> 8. A SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER BE <br /> PAID PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> 9. A GRADING AND EROSION CONTROL PLAN BE APPROVED BY THE CITY <br />. ENGINEER PRIOR TO THE ISSUANCE OF BUILDING PERMITS. <br />
