<br />Planning Commission Minutes <br />February 29,2000 <br />Page 8 <br /> <br />. <br /> <br />office for a remodeling business, but they have not heard anything further from <br />him. <br /> <br />Discussion followed regarding other single family homes in the office district which <br />are still used as residences. <br /> <br />Chair Thompson stated she would not be comfortable removing the condition <br />but would consider extending the time for removal of the house. Commissioner <br />Morphew agreed with Commissioner Thompson and felt that there would be no <br />incentive to remove the house if the condition were taken out. <br /> <br />Commissioner Baker asked what the appraised value of the home was. Mr. Jerry <br />Smith stated that the house is appraised at $95,000, but would be much more <br />valuable as a commercial use. <br /> <br />Peter Beck asked if the applicant has asked the City for redevelopment <br />assistance. Mr. Jerry Smith stated that they have not, but it would be a possibility <br />to consider. <br /> <br />Commissioner Schuster was opposed to tearing the house down. He felt it would <br />be more detrimental to the neighborhood than leaving it stand and supported <br />an extension for removal. <br /> <br />Commissioner Chambers questioned extending the time frame unless there was a <br />reason. <br /> <br />. <br /> <br />Mr. Jerry Smith stated that when they purchased the property, there were 2 <br />homes on the three lots. There office building at 403 Main Street is built on 1-1/2 <br />lots. <br /> <br />Discussion followed regarding the issue of two principle structures on one zoning <br />lot. <br /> <br />Commissioner Schuster asked how the lot would look if the house were removed. <br />Staff explained that the property owner would be required to meet the normal <br />City requirements for screening and landscaping of the parking lot, and filling the <br />basement in. <br /> <br />COMMISSIONER SCHUSTER MOVED TO DENY THE REQUEST BY TIM SMITH FOR AN <br />AMENDMENT TO CONDITIONAL USE PERMIT NO. CU 94-17 TO ELIMINATE <br />CONDITION #4, WHICH REQUIRES REMOVAL OF THE HOUSE ON LOT 3, AND EXTENDS <br />THE TIME PERIOD TO JUNE 24, 2003, BASED ON THE FOLLOWING FINDINGS: <br /> <br /> 1. <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br />. 6. <br /> <br />THE GOAL OF THE CITY IS TO DEVELOP THE PROPERTY AS OFFICE COMMERCIAL. <br />THE PLANNING COMMISSION DOES NOT FEEL EXTENSION OF THE TIME IS <br />DETRIMENTAL TO THE SURROUNDING NEIGHBORHOOD. <br />THE PROPERTY OWNERS ARE ACTIVELY MARKETING THE PROPERTY. <br />TEARING DOWN THE HOUSE AND LEAVING A VACANT LOT WOULD BE <br />DETRIMENTAL TO THE NEIGHBORHOOD. <br />MIXED USES ALREADY EXIST IN THE NEIGHBORHOOD. <br />SETTING A TIME LIMIT OF AN ADDITIONAL THREE YEARS WILL LIMIT THE LONG <br />TERM USE OF THE PROPERTY AS RESIDENTIAL. <br />
