Marc Bailey Request for Conditional Use Permit for Home Occuoation, Public Hearina Case No. CU 99-15 Steve Wensman indicated that the applicant has decided to withdraw his application and was no longer present. . COMMISSIONER KUESTER MOVED TO TABLE THE REQUEST BY MARC BAILEY FOR A CONDITIONAL USE PERMIT, PUBLIC HEARING CASE NO. CU 99-15, TO THE JUNE 22, 1999, PLANNING COMMISSION MEETING, PENDING RECEIPT OF A WRITTEN REQUEST FROM THE APPLICANT FOR WITHDRAWAL OF HIS APPLICATION. COMMISSIONER THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 5-0. 6.5. Reauest by City of Elk River for Zone Change to Remove Certain Prooerties from the Wild and Scenic River Overlay Zoning District Public Hearing Case No. ZC 99-4 Request by City of Elk River for Ordinance Amendment Section 906 - Wild & Scenic River Ordinance, Public Hearing Case No. OA 99-10 Request by City of Elk River for Ordinance Amendment to Section 900.12 - Wild & Scenic River District Public Hearina Case No. OA 99-11 6.6. 6.7. Steve Rohlf reviewed the requests by the City of Elk River for a zone change and two ordinance amendments related to the Wild and Scenic River Ordinance. Steve discussed the history of the City's struggle since 1996 to resolve issues associated with the DNR's version of the Wild and Scenic River Ordinance which places unreasonable restrictions on property owners. He explained that the City modified the draft ordinance to make it compatible with the City's Comprehensive Plan and it was rejected. He explained that it appears the DNR's planning process could drag on another 2 to 3 years. Steve reviewed boundary locations, uses, lot size and setback changes which would make the Ordinance compatible with the City's Comprehensive Plan. Staff recommends approval of the zone change and ordinance amendments as proposed in the staff report to the Planning Commission dated May 25, 1999. .
