<br />Planning Commission Minutes <br />March 23, 1999 <br />Page 5 <br /> <br />. <br /> <br />. <br /> <br />1. <br />2. <br />3. <br />4. <br />5. <br />6. <br />7. <br />8. <br />9. <br />. <br /> <br />conditions outlined in the staff report with a change to Condition No. 11 to reflect <br />that concrete curb and gutter only be required at the drive entrances extending <br />back to the building wall, until such time that the parking lot is substantially <br />improved. <br /> <br />Chair Cote opened the public hearing. <br /> <br />Tom Brown, representing Union Congregational Church, asked that the Planning <br />Commission consider the modification to condition Number 11 regarding curb <br />and gutter. as proposed by staff. Mr. Brown indicated that he felt the street <br />lighting would be adequate for the parking lot, and indicated that if light poles <br />were required within the site, they would likely have to be removed when the <br />parking lot was expanded. Mr. Brown indicated that church representatives <br />have met with the neighboring residents and no issues were encountered. He <br />also stated he did not feel the one way proposed by staff would be a problem. <br /> <br />There being no further comments from the public, Chair Cote closed the public <br />hearing. <br /> <br />Commissioner Kuester questioned how many additional lights would be required. <br />Staff indicated that it depended on the style of lighting and how much lighting is <br />already provided by the street lights. <br /> <br />COMMISSIONER MESICH MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVAL OF THE REQUEST BY UNION CONGREGATION CHURCH FOR A <br />CONDITIONAL USE PERMIT, PUBLIC HEARING CASE NO. CU 99-11, WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />THAT THE CHURCH PROPERTY, LOTS 10, 11, 12, 13, 14, HOULTON'S ADDITION BE <br />COMBINED AS ONE LOT. <br /> <br />THAT A VARIANCE BE GRANTED FROM THE PARKING SETBACKS PRIOR TO <br />WIDENING THE DRIVE ALONG THE NORTH SIDE OF THE CHURCH. <br /> <br />THAT THE BUILDING CONFORM TO THE UNIFORM BUILDING CODE AND ANY <br />RECOMMENDATIONS OF THE BUILDING AND ZONING DEPARTMENT. <br /> <br />THAT THE SITE BE LIGHTED TO CONFORM WITH THE ELK RIVER CITY ORDINANCE. <br /> <br />THAT THE SITE BE BUFFERED ALONG THE NORTH PROPERTY LINE TO AN OPACITY <br />OF 80% AS REQUIRED BY THE ELK RIVER CITY ORDINANCE. <br /> <br />THAT TREES REMOVED FOR CONSTRUCTION PURPOSES BE REPLACED ON SITE. <br /> <br />THAT ANY DRIVE LANES LESS THAN 24 FEET WIDE BE SIGNED FOR ONE-WAY <br />TRAFFIC. <br /> <br />THAT THE DRIVEWAY AROUND THE CHURCH BE SIGNED NO-PARKING. <br /> <br />THAT THE PARKING ADJACENT THE EXISTING GARAGE BE SIGNED AND LIMITED <br />TO ONE VEHICLE. <br />
