Paul <br />indicated that the project proposed for TIF District # 19 consists of a mixed use <br />(commercial and industrial) PUD located at the southeast corner of Highway 169 <br />and Main Street. <br /> <br />COMMISSIONER KUESTER MOVED APPROVAL OF RESOLUTION NO. 98-2, A <br />RESOLUTION FINDING THAT THE MODIFICATIONS TO THE DEVELOPMENT PROGRAM <br />FOR MUNICIPAL DEVELOPMENT DISTRICT NO.1 AND THE ADOPTION OF THE TAX <br />INCREMENT FINANCING PLAN FOR TIF DISTRICT NO. 19 CONFORM TO THE GENERAL <br />PLANS FOR THE DEVELOPMENT AND REDEVELOPMENT OF THE CITY. COMMISSIONER <br />THOMPSON SECONDED THE MOTION. THE MOTION 6-0. <br /> <br /> <br />Staff report by Steve Rohlf. Elk River Landfill is requesting an amendment to their <br />conditional use permit in order to construct a new demolition debris cell at their <br />facility. The cell is designed to be approximately 24 acres in size. Approximately <br />18 acres of the new cell are proposed to be located on top of the solid waste in <br />the original cell of the landfill, which is located within the city limits. A little more <br />than 6 acres of cell will be new landfill area that extends into Livonia Township. <br />Staff is also considering the Landfill's required two year review and renewal of <br />their conditional use permit and solid water facility license at this time. <br /> <br />Commissioner Kuester asked how reclamation of the cell would be affected. <br />Steve Rohlf indicated the reclamation plan would be the same. He explained <br />that a cap would be placed on top of the cell when it reached capacity. <br /> <br />Chair Mesich opened the public hearing. <br /> <br />John Toth, 22915 Highway 169, asked if the cap would be removed from the <br />existing cell. Steve Rohlf explained that only the top soil would be removed and <br />the cap would not be disturbed. <br /> <br />Deb McDonald of USA Waste, explained how the site would be prepared and <br />filled. <br /> <br />There being not other comments from the public, Chair Mesich closed the public <br />hearing. <br /> <br />COMMISSIONER THOMPSON MOVED THE PLANNING COMMISSION RECOMMEND <br />APPROVAL OF THE REQUEST BY ELK RIVER LANDFILL FOR AN AMENDMENT TO THEIR <br />CONDITIONAL USE PERMIT, PUBLIC HEARING CASE NO. CU 98-17, WITH THE <br />FOLLOWING INCORPORATED IN ELK RIVER LANDFILL'S CONDITIONAL USE PERMIT <br />AND SOLID WASTE FACILITY LICENSE: <br /> <br />1. THE STIPULATIONS LISTED IN THE JOINT LETTER FROM MPCA, SHERBURNE <br />COUNTY AND THE CITY OF ELK RIVER DATED JUNE 8, 1998. <br /> <br />2. THE REVISIONS LISTED IN MATTHEW LEDVINA'S LETTER, OF LIESCH <br />ASSOCIATES, DATED JUNE 18, 1998. <br />
