Applicable Regulation <br />In approving a CUP, the Council may impose such specific conditions with regard to the development or <br />operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section <br />30-654 and the requirements contained in this article and to promote compatibility with and minimize <br />any potentially adverse effects upon adjacent properties, the neighborhood or the city. <br />The issuance of a CUP can be ordered only if the use at the proposed location: <br />7. 1Vill not endanger•, injure or - detrimentally affect the use and enjoyment of othe-pi operty in the immediate vicinity or - <br />the public health, safety, moials, comfort, convenience orgeneial welfare of the neighborhood or the city. <br />The proposed use is self-contained, regulated by the State of Minnesota, and does not generate <br />significant traffic. After discussion with the police department, staff determined the proposed use <br />does not pose a security threat to the city. The site is adjacent to Highway 10 and has access to a <br />signalized intersection. Most traffic generated by the use will utilize this intersection. For these <br />reasons, along with the extensive visual screening, the use is not expected to detrimentally affect <br />the use and enjoyment of the other properties in the area. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />2. Vi// be consistent with the comprehensive plan. <br />The parcel and surrounding area are guided for residential uses. City ordinances allow Institutional <br />Uses with a CUP in all residential districts. The use is consistent with our residential zoning <br />ordinance and is consistent with the Comprehensive Plan. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />3. Vi// not impede the normal and orderly development and improvement of survounding vacantproperty. <br />Surrounding properties are fully developed and use will not impede the normal and orderly <br />development and improvement of surrounding properties. <br />Staff does not see a need to impose specific conditions to satisfy this standard. <br />4. Vi// be served adequately by and will not adversely affect essential public facilities and services including streets, <br />police and fire protection, drainage, refuse disposal, water and server systems, parks and schools; and will not, in <br />particular•, create trafc congestion or interference with trafc on adjacent and neighboring public thoroughfares. <br />The police department reviewed the proposed use and police records from other cities with IRTS <br />facilities operated by ResCare. Staff does not believe the facility will adversely impact police <br />protection. <br />The use may increase the sewer and water use of the property and the SAC/WAC units will be re- <br />evaluated at the time of building permit review. Any increase in the number of units will need to <br />be paid prior to issuance of the building permit. <br />Staff included a condition addressing changes to the SAC/WAC calculations. <br />5.
