(1) The period of time for which the interim use permit is to be granted will terminate before any adverse impacts are felt
upon adjacent properties.
Permanent use as a parking lot will terminate before the neighborhood is completely built out and
the replacement with a single-family home will fully comply with the ordinance.

(2) There is adequate assurance that the property will be left in suitable condition after the use is terminated.
The requirement to remove gravel base materials and de-compact the soil beneath the parking area
will leave the site in a suitable condition for residential development.

(3) The use is similar to uses allowed in the zoning district in which the property is located.
The use is complimentary to the sale and development of the Miske Meadows neighborhood.

(4) The date or event that will terminate the use can be identified with certainty.
The applicant states the use will last for 2 to 3 years, which is the expected timeline for this area of
the subdivision to fully develop. Staff has also included a condition of approval that the parking
area is to be removed three years from the tentative date of Council approval.

(5) Authorizing the use will not impose additional costs on the public if it is necessary for the public to take the
property in the future.
Additional cost will not be imposed.

(6) The applicant and user agree to all conditions that the city council deems appropriate for authorization of the
interim use.
The applicant and user agree to all conditions.

(7) The applicant provides assurances deemed adequate by the city council that the use will terminate as provided in the
interim use permit. The city council may require the applicant to deposit a cash amount with the city, or provide
some other form of security, to ensure compliance with this criteria.
The termination event is deemed adequate.

(8) Authorization of the interim use will not result in adverse effects on the public health, safety, or welfare.
The interim use will provide clients with an opportunity for off-street parking in a developing
residential neighborhood. It will not result in adverse effects on the public health, safety, or
welfare.

(9) The proposed interim use is consistent with the City of Elk River Comprehensive Plan and conforms to the city's
zoning regulations.
The use is consistent and conforms to the Comprehensive Plan and zoning regulations.

Statutory Review Period
The statutory review period will expire on December 28, 2018.

Council Meeting
With a recommendation from the Planning Commission on November 27, 2018, the City Council will
review the request on December 17, 2018.

N:\\Departments\\Community Development\\Planning\\Case Files\\IUP\\IU 18-01 D.R.
