<br />ORDInANCE NO. 70 <br />ORDIlaJlCE ESTABLISHING <br />A PIAIDITNG COHMISSION <br /> <br />follows: <br /> <br />The Village Council of the Village of Elk River ordains as <br /> <br />Section 1. Title. The ordinance shall be known as the Planning <br />Commission Ordinance Of1.he Village of Elk River. <br /> <br />Section 2. Purpose. To utilize the authority provided by Chapter <br />471.26 to 471.", inclusive, Hinnesota Stat.utes Annotated, to the I!1Unicipal- <br />ities of the State of Hinnesota to carry on planning activities and adopt <br />a plan for the regulation of the future physical development. of the I!1Uni- <br />cipality. <br /> <br />Section ,. Planninl!: Commission. There is hereby established a <br />planning commission of not less t.han seven nor more than nine members, <br />consisting ot resident voters of the Village of Elk River, at least one <br />of which shall be a member of the Village Council, whose purpose, when <br />est.ablished shall be to carry on the dut.ies conveyed to this I!1Unicipality <br />by said statutes, under the direction and. control ot this council. <br /> <br />Section 4. Terms of office. Hembers ot t.he commission shall <br />be appointed by the Village Council and shall serve for a term of three <br />years provided that. the initial appoint.ments to the commission shall be <br />such that not less than 1/' of its members shall be for a tem of one <br />year, not less than 1/3 for a t.erm of two years and not less than 1/3 <br />for a three year tem. <br /> <br />Section S. Heetinp;s The commission shall llleet within one month <br />from the date of its establishment, and thereafter not less than once each <br />quarter. The commission shall elect its awn chairman who will preside at <br />all meetings, and secretary who will record all business transacted and <br />all act.ions of the commission of whatsoever nature and keep said records <br />available for inspection at all reasonable hours. The commission may elect <br />what ot.her officers it deems neoessary to the proper conduct of its business. <br /> <br />Section 6. Duties. The ooIllllission shall make inquiry into all <br />matters relating t.o t.'b;'"'fUture lay out, platting, dedication of streets, <br />purposed alteration of existing lands and public spares, the future devel- <br />opment of unplatt.ed lams, and the quest.ion of approval or disapproval of <br />proposed subdivisions, the need of the village for land. for it.s awn pur- <br />poses, and the proposed amendments to existing Ordinance No. 61 (Zoning <br />Ordinanoe) and other related matters or matters incidental thereto. The <br />action of the commission, if any, shall oonsist of a recommendation to <br />the Village Council, ;Tho thereafter shall oonsidersuch reco~endation, <br />but shall not hereby limit its discretion to approve or disapprove such <br />reCOl1"Jlllen:1at5.on. <br /> <br />Section 7. Authority. No matter of which the Planning Collllllissionhas cognizanoe hereunder shall be submitted t.o the council until first <br />submitted to the commission. <br /> <br />Section 8. Hap. The Commission shall prepare a map embodying <br />its recommendations, which if adopted by the council shall thereafter be <br />known as the "Official Village Hap". The commission may lrll:hin the lir.1i. ta- <br />tions of its budget retain engineers or other expel"'~3 to assist it in its <br />performance of its duties. <br /> <br />Section 9. Funds. The commission shall, prior to the 1st day of <br />
