<br />AGREEMENT FOR EASEMENT

<br />This agreement made and entered into this ~day of October,
<br />196), by and between the Fullerton Lumber Company, a corporation, party of
<br />the first part, its successors and assigns, and the Village of Elk River,
<br />a municipal corporation, party of the second part, witnesseth:
<br />
<br />WHEREAS, the party of the first part owns and has title to cer-
<br />tain real estate situated in the County of Sherburne and State of Minnesota
<br />and described as follows:
<br />
<br />That part of Lot ), Block 2), Original Plat of the Village of
<br />Elk River, Sherburne County, Minnesota, described as follows:
<br />Beginning at the Northwest corner of the East 227 feet of the
<br />North Half (N 1/2) of said Block; thence South along the West
<br />line thereof a distance of )4.9 feet; thence East at right angle
<br />1.4 feet; thence South 198 feet to a point 145 feet East of the
<br />East line of (Park Street) now Morton Avenue; thence Easterly
<br />to a point 187.3 feet West of the East line of said Block 23
<br />and 213.47 feet South of the intersection of the East line of
<br />said East 227 feet of the North Half (N 1/2) of said Block 23
<br />and the Southerly right-of-way line of U. S. Highway No. 10;
<br />thence Northerly to said point of intersection; thence North-
<br />westerly along said right-of-way line to its intersection with
<br />the North line of said Block 23; thence West along said North
<br />line to the point of beginning, and
<br />
<br />WHEREAS, the party of the first part has located and established
<br />on said lands and premises a building described and designated as a lumber
<br />yard and lumber yard office, and
<br />
<br />WHEREAS, the party of the second part desires to construct and
<br />locate on top of said building a siren to be used for purposes of fire
<br />calls, fire meetings, curfews and other emergency purposes not herein
<br />specified.

<br />NOW, THEREFORE, IT IS AGREED, by and between said parties as
<br />
<br />follows:
<br />
<br />1. That the party of the first part does hereby grant, assign
<br />and set over to the party of the second part, the right to construct such
<br />siren, so-called, at the expense of the party of the second part for the
<br />uses and purpos~s hereinbefore specified for an undeterminate period of
<br />time.
<br />
<br />2. That the party of the first part shall fully use and enjoy
<br />the aforedwscribed premises except as to the rights herein granted and
<br />the party of the second part hereby agrees to hold and save the said
<br />party of the first part harmless from any and all damage arising from its
<br />use of the right and easement herein granted and agrees to pay any damage
<br />or damages which may arise to the property, premises or rights of the
<br />party of the first part through the second party's use, occupation and
<br />possession of the rights herein granted; that in exchange for such agree-
<br />ment, the party of the second part does hereby agree to pay the party of
<br />the first part the sum of $1.00 per year in addition to the other consid-
<br />eration hereinbefore described.

<br />IN TESTIMONY WHEREOF, the parties have hereunto set their hands
