<br /> <br />Request for Action <br /> <br /> <br />To Item Number <br />Mayor and City Council 4.10 <br />Agenda Section Meeting Date Prepared by <br />Consent October 15, 2018 Zack Carlton, Planning Manager <br />Item Description Reviewed by <br />Deed Conveyance: Miske Meadows Outlots Brandon Wisner, Stormwater Coordinator <br />Peter Beck, City Attorney <br />Reviewed by <br />Cal Portner, City Administrator <br /> <br />Action Requested <br />Accept, by motion, two outlots within the Miske Meadows subdivision for use as stormwater ponds. <br /> <br />Background/Discussion <br />The Miske Meadows subdivision includes a number of outlots set aside for use as stormwater ponds. The <br />public infrastructure for these facilities is complete and the ponds have been constructed to the city’s <br />satisfaction. The ponds will be maintained by the city and access is provided via easements or parcel <br />connections to the street. <br /> <br />In the past, the city has not taken ownership of outlots dedicated to stormwater management, but we <br />have seen many of these go tax forfeit and then are picked up by the city or remain in a state of forfeiture. <br />Accepting ownership of the lots allows the city to more easily regulate encroachments into the required <br />setbacks, and eliminates the possibility of tax forfeiture in the future. <br /> <br />Financial Impact <br />The stormwater features will be maintained by the city in perpetuity in accordance with state municipal <br />separate stormwater system requirements. <br /> <br />Attachments <br /> Quit Claim Deed <br /> <br /> <br />The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional <br />service, and community engagement that encourages and inspires prosperity <br />
