Analysis <br />The applicanthasfourGermanShepherds (8animalunits) andoneMaltipoo (1animalunit), for atotal <br />ofnineanimalunitsasdefined underElkRivercityordinances. Thecityallowsuptosixanimalunits <br />without aCUP, butthe applicantisapplyingforaCUPtohousethenineanimal unitsthey currently <br />own. <br />Thedogsarenormallykeptindoors, where theyarefedandwatered. Theproperty hasa fencedbackyard <br />forthe dogsto play, andtherearenooutdoor kennel structures. <br />Applicable Regulation <br />Theissuance ofaConditionalUse Permitcan beordered onlyiftheuse atthe proposed location: <br />1. Willnotendanger, injure ordetrimentally affecttheuseandenjoyment ofother propertyintheimmediate vicinity <br />orthepublic health, safety, morals, comfort, convenienceorgeneralwelfareoftheneighborhood orthe city. <br />Multiple reports ofdogslooseintheneighborhood havebeenreceived bythePolice <br />Department; seeattached. Numerous writtenwarningsandpolicecitations havebeen issuedfor <br />dogs atlargeandunlicensed dogsbetween 2011and2017. Achainlinkfencewasinstalled inthe <br />backyard of thepropertyin2016toprevent thedogsfromescaping, andsinceinstallation ofthe <br />fenceonlyoneloosedoghasbeenreported. <br />2. Willbeconsistentwiththecomprehensive plan. <br />Therequest isconsistentwiththecomprehensive plan, whichguidestheproperty forresidential <br />uses. <br />3. Willnotimpedethenormal andorderly development andimprovement ofsurrounding vacantproperty. <br />Therequest will notimpede development asthesurrounding areasareeitherundevelopable <br />wetlands, ordevelopedresidentiallots. <br />4. Willbeserved adequatelybyandwillnotadverselyaffectessential public facilities and servicesincluding streets, <br />policeandfireprotection, drainage, refusedisposal, water andsewer systems, parksandschools; andwillnot, in <br />particular, create trafficcongestion orinterference withtraffic onadjacentandneighboring public thoroughfares. <br />Theproperty isadequately served bytheses facilitiesandthe proposalwill notimpede them. <br />5. Willnotinvolve uses, activities, processes, materials, equipment andconditions ofoperationthatwillbe <br />detrimental toanypersonsorpropertybecause ofexcessivetraffic, noise, smoke, fumes, glare, odors, dustor <br />vibrations. <br />Therehavebeen reportsandcomplaints ofexcessive odorfrom feces inthebackyard. Thesmell <br />isreported tobestrongenough toextendpast property lines. Occasional barking at nighthas <br />been reported tocitystaff, butnopolice complaintshavebeenreceived. Toaddress these <br />concerns staffproposes acondition thatthe fecesbe cleanedtwiceweekly – toinclude the <br />winter months. <br />6.
