Request for Action <br />To <br />Item Number <br />Mayor and City Council <br />4.7 <br />Agenda Section <br />Meeting Date <br />Prepared by <br />Consent <br />September 4, 2018 <br />Zack Carlton, Planning Manager <br />Item Description <br />Reviewed by <br />Abatement Agreement for 1772 Tipton Circle NW <br />Peter Beck, City Attorney <br />Reviewed by <br />Cal Portner, City Administrator <br />Action Requested <br />Approve, by motion, the Nuisance Abatement and Special Assessment Agreement for 1772 Tipton <br />Circle. <br />Background/Discussion <br />On August 6, 2018, the City Council, after discussion with the owner of 1772 Tipton Circle NW, delayed <br />action on approving the Nuisance Abatement and Special Assessment Agreement until September 4, <br />2018. Staff has made weekly visits to the property and met with the tenant on at least one occasion. <br />As of August 29, 2018, sufficient progress regarding the site clean-up has not been made, and staff <br />recommends approval of the agreement. <br />The city attorney, in working with the attorney for the property owner, prepared the attached abatement <br />agreement to provide the city with the authority to go onto the property and remove vehicles and rubbish <br />that does not comply with city codes. Staff solicited bids from area contractors to establish the abatement <br />cost and complete the work upon authorization. The stated $30,855.00 cost to clean-up the site is the <br />maximum that will be assessed using this agreement, and the final amount abated will reflect the actual <br />work completed. <br />Once both parties, the city and the property owner, have signed the abatement agreement staff will work <br />with the property owners, tenant, and contractors to bring the property into compliance with city codes. <br />Financial Impact <br />The initial cost of the nuisance abatement will be paid by the city.
