Any invalidity or unenforceability of any provision or application of this guaranty shall not <br />affect other lawful provisions and applications hereof and to this end the provisions of this guaranty <br />are declared to be severable. This guaranty shall bind the undersigned and the heirs, representatives, <br />successors and <br />assigns of theundersigned, and of each of them respectively, and shall benefit the Lender, <br />its successors and assigns. This guaranty shall be governed by and construed in accordance with the laws <br />of the State of Minnesota.· <br />The undersigned is the owner of the real property commonly known as 13374 U.S. Highway <br />10, Elk River, Minnesota (the "Property"). Borrower is the tenant of the Property, pursuant to a <br />written lease with the undersigned. The undersigned acknowledges and agrees that the Indebtedness <br />is being utilizedby Borrower to make permanent and valuable improvements to the Property, <br />the ownership of whichimprovements will revert to Corporate Guarantor upon the expiration of the <br />Lease and therefore, theundersigned's obligations under this Guaranty are proper, valid and enforceable. <br />The undersigned's obligations hereunder are secured by that certain. Mortgage and <br />Assignment of Rents and Security Agreement and Fixture Filing made by the undersigned to Lender <br />of even date herewith. <br />THE UNDERSIGNED REPRESENT, CERTIFY, WARRANT AND AGREE THAT THE <br />UNDERSIGNED HAVE READ ALL OF THISGUARANTY AND UNDERSTAND ALL OF <br />THE PROVISIONS OF THISGUARANTY.
