_\ <br /> ,•'` ELK RIVER MUNICIPAL UTILITIES <br /> a 322 King Avenue <br /> Elk River, Minnesota 55330 <br /> Phone (612) 441-2020 <br /> UTILITIES COMMISSION MINUTES <br /> November 3, 1993 <br /> 3 :00 P.M. <br /> Present Were: James Tralle President <br /> James Simpson Vice Chairman <br /> George Zabee Trustee <br /> Others Present: Bill Birrenkott General Manager <br /> Bob McCartney Water Superintendent <br /> Pat Klaers City Administrator <br /> 1) The meeting was called to order at 3:00 P.M. by President <br /> Tralle. <br /> 2) Motion by Mr. Simpson, seconded by Mr. Zabee to approve the <br /> agenda as amended. The Motion carried. <br /> 3) Motion by Mr. Zabee, seconded by Mr. Simpson to approve the <br /> minutes of the previous meeting. The motion carried. <br /> 4 ) A proposal from the Clinkscales Family Trust for the sale of <br /> property next to the Power Plant was discussed. There was a <br /> large difference between the asking price and the appraisal <br /> price authorized by the Commission. Motion by Mr. Zabee, <br /> seconded by Mr. Simpson, to authorize a second appraisal on the <br /> property and report the results to the Commissioners for future <br /> action. The motion Carried. <br /> 5) Bob McCartney reported that MSA had sent us the first payment <br /> request for the water tower with their approval. Motion by Mr. <br /> Zabee, seconded by Mr. Simpson to approve Partial Pay Estimate <br /> No. 1 to CBI Na-Con in the amount of $64,840.50 as approved by <br /> MSA. The motion carried. <br /> 6) The location of facilities in public or private Right of Way <br /> was discussed. Motion by Mr. Simpson, seconded by Mr. Zabee <br /> to place the following resolution in the Minutes of the <br /> meeting. <br /> The Elk River Utilities would be glad to comply <br /> with the desires of the City Council if they <br /> would like to see the priority placement of <br /> electrical facilities to be in the Street Right <br /> of Way. The Utilities would like to retain the <br /> right, if terrain, soil conditions or other <br /> difficulties dictate, to place these facilities <br /> in the private easement. <br /> The motion carried. <br />
