Planning Commission/CU 03-23 <br /> August 20,2003 <br /> Page 2 <br /> IIIStandards for Issuance of a Conditional Use Permit <br /> The issuance of a Conditional Use Permit can be ordered only if the use at the proposed <br /> location: <br /> 1. Will not endanger,injure or detrimentally affect the use and enjoyment of other property in the <br /> immolate vicinity or the public health,safety,morals,comfort,corarnience or general welfare of the <br /> neighborhood or the city. <br /> 2. Will be consistent with the camprehernsize plain. <br /> 3. Will not impale the normal and orderly dezelopnent and impnnement of surroundingsacant <br /> Prol <br /> 4. Will be send adequately by and will not a wisely affect essential publicfacilities and services <br /> including streets,police and fire protection,drainage,refuse disposal,neater and sewer system,parks <br /> and schools;and will not,in particular,create traffic congestion or interference with traffic on <br /> adjacent and neigh&irmg public thoroughfares. <br /> 5. Will not intd ze uses,activities,processes,materials,equipment and conditions of operation that will <br /> be detrimental to any persons or property because of excessive traffic,noise,smoke,fumes,glare, <br /> odors,dust or vibrations. <br /> 6. Will not result in the destruction,loss or damage of a natural, scenic or historic feature of major <br /> importanm <br /> 7. Willfully comply with all other requirements of this Code,incluckng any applicable require errs <br /> and standards for the issuance ofa license or permit to establish and operate the proposal use in the <br /> city. <br /> 1111 If denial of such a permit should occur,it shall accompany recommendations or <br /> determinations by findings or a report stating how the proposed use does not comply with <br /> the standards set forth in section 30-654. <br /> Overview <br /> The subject property is located at the northeast intersection of Highway 10 and Joplin Street, <br /> just east of and adjacent to the Fox Haven subdivision. The proposed garage would be <br /> placed in the northwest corner of the complex on the south side of an existing cul-de-sac. It <br /> will be a 24-foot by 24-foot with a 16-foot wide garage door. The garage will be sided with <br /> double 4" vinyl siding. The submitted plan did not shown how close to the street the <br /> garage would be or if it would be accessed by a paved surface. <br /> Recommendation <br /> Staff recommends that the Planning Commission recommend approval of the Conditional <br /> Use Permit to construct a garage with the following conditions: <br /> 1. THE BUILDING SHALL MEET ALL APPLICABLE BUILDING AND <br /> FIRE CODES. <br /> 2.
