• <br /> 1. Access <br /> Access is perhaps the most critical issue regarding the request. Also, as of the <br /> date of this memo, this issue has not been totally resolved. The following <br /> discussion and conditions contained in the attached permit are subject to change. <br /> The main use for the gravel that would be mined under this request is for use at <br /> the Elk River Bituminous Asphalt batch plant, which is approximately 1/4 mile <br /> south of the site (noted on the attached vicinity map). MnDOT prefers not mixing <br /> the slow moving trucks hauling gravel with high-speed highway traffic. Three <br /> options for gaining access to the Elk River Bituminous site have been considered. <br /> a. Staff requested that the petitioner negotiate an easement from the <br /> property owner that lies between his site and Elk River Bituminous, <br /> eliminating the need to gain access to Highway 169 (noted on the <br /> attached vicinity map as "Access via easement to the south). This <br /> option apparently fell through with the adjacent property owner. <br /> b. Access to Highway 169 via 219th Avenue. This is not MnDOT's <br /> number one preference and it will require significant improvements to <br /> the Highway(auxiliary lanes being added between 219th Ave. and the <br /> . Elk River Bituminous site northbound and southbound). If allowed, <br /> access to the Highway at 219th Avenue is temporary and would need to <br /> be eliminated when frontage roads leading to interchanges are <br /> developed. <br /> c. Access to Highway 169 at 225th Ave. (noted as "Access via easement <br /> to the north"). <br /> If 219th Avenue is used as the access,portions of the drive that accesses two <br /> existing residences and two businesses will be shared with the gravel truck <br /> associated with the mining operation. The subject property has easement rights <br /> for access across the parcels that the business and residents are situated on. <br /> However this access is currently nothing more than a private driveway. To safely <br /> allow for two-way traffic and due to concerns regarding dust, staff is <br /> recommending that the portion of this drive that are shared must be a minimum of <br /> twenty feet wide and paved. The petitioner must also document that he has the <br /> right to do these improvements on the property that is not in his control and <br /> spelling out whom is responsible for maintenance. <br /> Some of the mined product will potentially be for sale. Staff is recommending <br /> that the Elk River Bituminous site be used for the sale of product under the <br /> stipulation that a permit from MnDOT for this additional commercial activity be <br /> • obtained if required. Staff anticipates MnDOT requiring improvement (e.g. <br /> acceleration lands and protected turn lanes)being required as part of this permit. <br />
