<br />RESOWTION INDICATm~ . INTENT TO JOIN WITH OTHER GENERAL PURPOSE' <br />UNITS OF LOCAL GOVERNMENT IN THE CENTRAL MINNESOTA AREA TO DEVELOP <br />AND IMPLEMENT A PLAN RESULTING IN A COORDINATED WASTE TREATMENT <br />MANAGEMENT SYSTEM FOR THE AREA. <br /> <br />WHEREAS, pursuant to Section 208 of the Federal Water Ppllution <br />Control Act Amendments of 1972, P.L. 92-500 (hereinafter called "the <br />Act"), the Administrator of the United States Environmental Protection <br />Agency has by regulation published guidelines for the identification <br />of those areas which, as a result of urban-industrial concentrations <br />or other factors, have substantial water quality control problems <br />(40 CFR Part 126); and <br /> <br />WHEREAS, the Central Minnesota area (hereinafter called "the <br />Area") satisfies the criteria contained in the Act and guidelines <br />and designation of the area pursuart:'J"to section 208 and those guidelines <br />is desirable; and <br /> <br />\~, Section 126.10 of the guidelines requires, among other <br />things, that the affected general pUIijO.l:;'le 'JIlits of local government <br />within the problem area must show their intent, through formally adopted <br />resolutions, to join together in the planning process to develop and <br />implement a plan which will result in a coordinated waste treatment <br />management system for the area; and <br /> <br />vlHEREAS, such planning process and waste treatment management <br />system is a necessary and significant measure to control present point <br />and non-point sources of water pollution and to guide and regulate <br />future development and growth in the area which may affect water quality, <br />in order to prevent, abate and solve existing and potential substantial <br />water quality control problems; <br /> <br />WHEREAS, pursuant to proposed U.S. EPA regulations, the Governor of <br />the State of Minnesota, may designate an areawide planning district <br />which includes local elected officials, capable of developing effective <br />areawide water quality plans; and <br /> <br />vlHEREAS, Section 208 authorized that existing areawide orgainizations <br />may be designated as the official water quality planning organization; and <br /> <br />vlHEREAS, the Environmental Protection Agency has issued guidelines <br />(40 CFR Part 126) for the designation of such organization; and <br /> <br />WHEREAS, the criteria contained in the U.S. EPA regulations for <br />designating such areawide planning orgainizations are applicable to the <br />Central Minnesota Area; and <br /> <br />WHEREAS, the Central Minnesota Regional Development Commission <br />(hereinafter called" Commission" has been actively engaged in water <br />resource planning within the Central Minnesota Area and is the representative <br />organization of the general purpose local governments within the Central <br />Minnesota Area for undertaking intergovernmental coordination and compre- <br />hensive planning for the region; and <br /> <br />WHEREAS, the Commission has formally requested that the Governor of <br />Minnesota designate the Central Minnesota Area as a substantial water <br />quality problem areas and the Commission as the single representative <br />organization to develop plans as called for under Section 208; and <br /> <br />vlHEREAS, the U.S. EPA regulations in Section 126.11 encourage the use <br />of existing capable regional organizations consistent with the policies <br />of Title IV of the Intergovernmental Cooperation Act of 1968, as implemented <br />by Part IV of OMB Circular A-95 to receive the designation as the single <br />responsible organization for such planning in designated areas; and <br /> <br />vnfEREAS, the designation of the Commission will insure the intergration <br />of water quality planning into the overall comprehensive developmental <br />planning process for the Central Minnesota Area; and <br /> <br />WHEREAS, such planning process will equip the Commission'S participating <br />governments ~~th a significant new tool both to guide and cort~rol development <br />and growth ~~thin the Central Minnesota Area together with an additional <br />basis for evolving a joint decision for the solution of the area's water <br />pollution problem: <br /> <br />NOd THEREFORE, IT IS RESOLVED THAT the City of Elk River, recognizing <br />
