Tree Ordinance • <br /> City of Elk River, Minnesota <br /> Definitions <br /> 1. As used within this ordinance,the following terms shall have the meanings set forth in this <br /> section: <br /> The word"shall" is mandatory and not merely directory. <br /> Alter <br /> To change the appearance by trimming/removing branches from a tree to amount to more <br /> than 25%of the original tree mass within one(1)year. <br /> Applicant <br /> A person who is applying for a license,certification or permit as required by this chapter. <br /> Boulevard <br /> That part of the property not covered by sidewalk or other paving, lying between the <br /> property line and the curb line of any street. In the absence of a curb,the curb line of a <br /> street shall be deemed to be the edge of that portion of the public right of way maintained <br /> and open to the use of the public for purposes of public travel. <br /> Caliper <br /> The diameter,in inches of a tree at a height of 12 inches above the ground. <br /> Certified Arborist <br /> Any person holding a valid and current arborist certification as issued by the International • <br /> Society of Arboriculture(I.S.A.) <br /> City Forester <br /> City forester or other qualified designated official of Elk River,Minnesota,assigned to <br /> carry out the enforcement of this Ordinance. <br /> Clearing <br /> The removal of vegetation from a property,whether by cutting or other means. <br /> Community Forest <br /> A collection of trees in and around the City including park and street trees on public <br /> property,and yard trees on private property. <br /> Community Forestry <br /> The ecology of native and non indigenous plantings creating a forest in the human living <br /> environment,and emphasizing the practice of wise professional planned management of <br /> all tree resources within an urban area including trees in public streets,public areas,and <br /> on private property to provide for multiple use benefits for the general well-being of the <br /> entire community. <br /> Critical Root Zone <br /> The area inscribed by an imaginary circular line on the ground beneath a Tree having as <br /> its center point the center of the trunk of the Tree and a radius equal to one foot for every <br /> inch of DBH. <br /> Damage <br /> To take any direct or indirect action that causes,or is reasonably likely to cause,the death <br /> of a Tree or a significant loss of a Tree's structural integrity including,without limitation, <br /> destruction,poisoning,carving,mutilating,girdling,severing the main trunk or large • <br />
