MAY 2Q 201? <br /> May 17, 2002 <br /> • <br /> Mississippi Oaks Homeowners <br /> Mississippi Oaks Development <br /> Elk River <br /> RE: The purposed plan for Phase III of Mississippi Oaks <br /> Dear Ms. McPherson and City Planners <br /> As the homeowners of Mississippi Oaks we all have questions on the planning of Phase III of Mississippi <br /> Oaks. As you have well been made aware for years, Mr.Moldenhaurer needs to be followed closely, <br /> very closely when developing his development. We have questions that we all feel need to be looked at <br /> before he should be allowed to continue. <br /> • Mr.Moldenhaurer has not followed city codes. Example: <br /> • Driveway widths etc.Knew what it should be, but did what he wanted it to be <br /> • Lot size - -told it was this size,when comes to have it staked out-completely in-correct. <br /> • Cutting of river trees etc. DNR was involved. Has he completed his requirements? He should be <br /> accounted for his large and costly mistake to nature. We were made aware by letter from the city <br /> stating that he would like to put in "walk-ins" along the river banks. He was told NO, but went ahead <br /> and proceeded to chop down trees along the bank and down the banks for his own good, not <br /> following city orders etc. <br /> • Allowing dumping of material in empty field by citizens of Elk River-not Mississippi Oaks Homeowners <br /> As discussed at your last planning meeting, in the beginning 6 years ago he had given the city 2 acres, <br /> correct me 2 acres along the back waters of the river to be left alone? Now it seems he has changed it to • <br /> only 1? Wasn't this in the plan from the beginning of the"development"of Mississippi Oaks? His signs say <br /> bike paths,that would be a nice walking or bike path along the banks. If he said 2 then 2 it should be. <br /> There are drainage culverts in the development that run along property lines in which are very necessary. <br /> Six years and still as of today many home back yards fill with water because the lack of proper drainage <br /> and grading. In the first purposed plan he has some of this left alone, (meaning drainage areas) now <br /> from the looks of things homes will be on the drainage path. Will this be allowed? <br /> We laugh because the"Mississippi Oaks" development name really is like"Mississippi No Oaks" from all <br /> of the trees which have come out or taken out by Mr.Moldenhaurer. Please consider some of the past <br /> problems when deciding his purposed plan. He has already taken the first action with or with out your <br /> recommendation in preparing his land. Please consider when making your decision the lack of respect Mr. <br /> Moldenhaurer has shown toward the city and his development homeowners. <br /> Thanks for your consideration <br /> Mississippi Oaks Homeowners <br /> This letter is for the city planning commission and Ms. McPherson.
