Memo to Planning Commission/P 01-14 <br /> August 28,2001 <br /> Page 6 <br /> The Historic Preservation Commission reviewed the project site. Stone artifacts have been <br /> IIIfound on the site. Their memo and recommendation is attached. <br /> Park Dedication <br /> At the Park and Recreation Commission meeting of August 8, 2001 the Commission <br /> reviewed the request for park dedication purposes. The Commission concurred with staff's <br /> recommendation that sidewalks should be provided on one side of each of the public streets <br /> and also a 50-foot trail easement should be provided to Hillside City Park. The Commission <br /> recommended cash dedication for the subdivision due to the presence of Hillside City Park, <br /> a recreation area directly east of and adjacent to the project. <br /> Recommendation <br /> Staff recommends the following to the Planning Commission: <br /> 1. Denial of the request for a waiver to the townhome moratorium as the applicant has not <br /> provided sufficient evidence of hardship. <br /> 2. Denial of the request to rezone the property from Single Family Dwelling to Planned <br /> Unit Development as after the adoption of the revised townhome moratorium, a <br /> townhome development will require a rezoning to R3, Multiple Family Dwelling. <br /> 3. Denial of the Preliminary Plat. <br /> 4. Denial of the Conditional Use Permit. <br /> • Without a rezoning to PUD,the preliminary plat and conditional use permit are void. The <br /> applicant could request approval of a single family plat and leave the multi-family portions as <br /> outlots until the revised ordinance is adopted and the moratorium lifted. <br /> If the Commission finds that the applicant has provided sufficient evidence of hardship to <br /> grant a waiver to the townhome moratorium, and the Commission elects to recommend <br /> approval of the remaining land use requests,staff recommends the following findings and <br /> conditions: <br /> Findings of Fact for the Rezoning Request <br /> I. THE REQUEST IS CONSISTENT WITH THE LAND USE PLAN. <br /> 2. THE REQUEST WILL NOT ADVERSELY IMPACT ADJACENT <br /> PROPERTY OWNERS OR LAND USES. <br /> 3. THE REQUEST PROVIDES AN OPPORTUNITY TO PROVIDE <br /> ADDITIONAL HOUSING TYPES AND STYLES SERVING A <br /> DIVERSE POPULATION WITHIN THE CITY. <br /> Conditions of Approval, Preliminary Plat and Conditional Use Permit <br /> • <br /> S:\PLANNING\MICHMC\PLREPRTS\P01-14.DOC <br />
