Memo to the Planning Commission/CU 00-40 <br /> November 14,2000 <br /> Page 2 <br /> • The applicant intends to enclose a 160 FT x 730 FT area (2.68 acres) with a <br /> fence to use as a pasture. The area proposed for the pasture is a mostly <br /> wooded area with a mix of wetland and upland forest with County Ditch 28 <br /> crossing the rear of the property. The property had no standing water at the <br /> time staff visited the site, however there is evidence of standing water on the <br /> aerial photo and by an analysis of plant species that occur on the site. City <br /> Ordinance requires an acre of pasture per horse. With a 2.68-acre pasture, <br /> City Ordinance allows the keeping of two horses. <br /> Accessory Structures <br /> The applicant intends to construct a 22 FT x 27 FT horse barn to provide <br /> shelter for the horses. With the horse barn, the property appears to have less <br /> than the maximum 3000 SF of allowed accessory structure area allowed by <br /> City Ordinance. <br /> County Ditch 28 <br /> County Ditch 28 crosses the rear of the property. To protect water quality in <br /> the City and to maintain the ditch easement free of structures, staff <br /> recommends that the pasture area be shortened to exclude the ditch area <br /> with a 20 FT buffer. With the ditch and buffer excluded from the pasture, <br /> • the pasture will be approximately 160 FT x 640 FT, (over 2 acres), in size. <br /> Setbacks <br /> The proposed barn and fence conform to the setback requirements. <br /> Recommendation <br /> Staff recommends that the Planning Commission recommend approval of a <br /> conditional use permit to keep a horse with the following conditions: <br /> 1. THAT THE ANIMAL WASTE BE DISPOSED OF PROPERLY. <br /> 2. THAT A BUILDING PERMIT BE OBTAINED FOR THE PROPOSED HORSE <br /> BARN. <br /> 3. THAT THE FENCE BE CONSTRUCTED TO CONFORM TO CITY <br /> ORDINANCE. <br /> 4. THAT THE COUNTY DITCH BE EXCLUDED FROM THE PASTURE AREA <br /> WITH A MINIMUM 20 FT BUFFER. <br /> 5.
