<br /> <br /> <br /> <br />~ <br /> <br />REGULAR SEMI-MONTHLY MEETING OF THE <br />CITY COUNCIL OF ELK RIVER <br />HELD IN THE ELK RIVER PUBLIC LIBRARY <br />February 4, 1980 <br /> <br />Members Present: Mayor Madsen, Councilmembers Engstrom, Toth and Duitsman. Councilman <br />Otto arrived at 9:30 p.m. <br /> <br />Members Absent: <br /> <br />None. <br /> <br />1. The meeting was called to order at 7:35 p.m. by Mayor Madsen. <br /> <br />2. Agenda <br /> <br />Item 13 1/2, use of park facilities, and item 15, next City Council meeting date, <br />were added to the agenda. COUNCILMAN TOTH MOVED APPROVAL OF THE FEBRUARY 4, 1980, <br />CITY COUNCIL AGENDA. COUNCILMAN DUITSMAN SECONDED THE MOTION. THE MOTION PASSED <br />3-0. <br /> <br />3. Minu tes <br /> <br />COUNCILMAN ENGSTROM MOVED APPROVAL OF THE MINUTES OF THE JANUARY 21, 1980, CITY <br />COUNCIL MEETING. COUNCILMAN DUITSMAN SECONDED THE MOTION. MOTION PASSED 3-0. <br /> <br />4. Open Mike <br /> <br />No one appeared for this item. <br /> <br />5. Sherburne County Fair Board Request <br /> <br />~epresentatives from the Sherburne County Fair Board were present to discuss the <br />agreement between the City and the County concerning the fairground land. The <br />Fair Board representatives requested the q~letion of the provision in the agree- <br />ment which states that if the site is no longer used by the Sherburne County Fair <br />Board for County fair purposes, the property reverts back to the City of Elk River. <br />The Fair Board re.presentatives indicated the Cbunty would not improve nor update <br />the buildings on the fairground unless they were owned by the County. Mayor <br />Madsen indicated he felt the pltoblem was the County Fair Board's rather than the <br />City's because according to his information if the property was given back to the <br />City it then went back to the Athletic Association. Mayor Madsen further indicated <br />if the County was given the use of the property for thirty years, the improve- <br />ments to the property would have their useful use and, furthermore, if the land <br />was given to the County and the Fair Board chose to mbve the fair, the City lost <br />the land. Mayor Madsen asked if the Fair Board would give the property back to <br />the City if they chose to move the County fair to another location and further <br />indicated he did not think it was unreasonable for the City to give the property <br />to the county for County fair purposes for a certain number bf years. Councilman <br />Toth indicated the Athletic Association had sold it to the City with the stipu- <br />lation that if the City did not use it, it was to return to the Athletic Associa- <br />tion and further indicated that the City gave it to the County for fair purpbses <br />with the same stipulation. Councilman Toth indicated the original lease was a <br />99 year lease. Councilman Duitsman indicated that if according to the agreement <br />the City did not use the property, it was to be returned to the Athletic Associa- <br />tion it would then be impossible to give it to the County. Mayor Madsen suggested <br />a meeting be scheduled between the Sherburne County Fair Board and the City Council <br />to discuss the issue and work,out the problem. <br />
