This item was discussed in 2016 as well, and <br />at the time it was determined that the cost was too great to make this feature within the park ADA compliant.   <br />   <br />One of the individuals involved in this project spoke with the MN DNR regarding ADA compliance and was <br />informed that if the cost is excessive, that we can determine it to not be financially feasible and therefore do not <br />need to follow ADA guidelines for accessibility.  <br />   <br />Can you provide any information as to the validity of the expense being an exemption to following ADA <br />requirements?   <br />   <br />Can we have a feature such as this dock/pier that does not meet ADA requirements and what type of liability would <br />that put us in?   <br />   <br />If it is determined based on the site that ADA compliance cannot be achieved, can we then construct the structure <br />as a permissible non-compliant facility?  <br />   <br />Any other information regarding ADA accessibility requirements for docks/fishing piers that you could send me <br />would be very much appreciated as this will help to guide our decision on how to proceed with this potential <br />project.  <br />   <br />Attached are the design options and information the group gathered back in 2016 regarding this project for your <br />reference.  <br />   <br />Thanks,  <br />   <br />Tim Sevcik | Public Works Superintendent  <br />763.635.1123 w | 763.635.1155 f  <br />19000 Proctor Road | Elk River | MN | 55330
