<br /> <br /> <br /> <br />City Council Meeting <br />June 9, 1981 <br />Page Seven <br /> <br />Attorney, Mr. Sellergren, advises that the Variance still should be denied <br />but further advises that a building permit could appropriately be issued so <br />that Mr. Swanson would be allowed to utilize his property. Discussion was <br />carried on regarding the timing of the consolidation of the City of Elk River <br />and the Township of Elk River, the interm ordinance and the recording of the <br />transfer of the property. The City Administrator indicated that the date of <br />the recording of the lot does not have any bearing on the Variance request, as <br />the ordinance does not allow for a building permit to be issued for a lot with- <br />out access to a public road. <br /> <br />Discussion was carried on regarding the procedure Mr. Swanson would have to <br />take to acquire a building permit for his lot. The City Administrator suggested <br />that Mr. Swanson get an appraisal of the property, and prove to the City Council <br />that there are no willing buyers or uses fOr the property. Questions were <br />raised as to how long the Swansons must advertise their property for sale. It <br />was the concensus of the City Council that the Swansons advertise their property <br />for sale for approximately two to four weeks. COUNCILMAN EWGSTROM MOVED TO DENY <br />THE VARIANCE REQUEST BY MR. LYLE SWANSON TO BUILD A SINGLE FAMILY DWELLING IN <br />AN A-I DISTRICT ON A PRIVATE ROAD EASEMENT. COUNCILMAN TOTH SECONDED THE MOTION. <br />THE MOTION PASSED 3-0. <br /> <br />16. Kreuser Preliminary Plat <br /> <br />The City Administrator indicated that the Planning Commission recommended approval <br />of the Preliminary Plat submitted by Mr. Gene Kreuser for the property located <br />in the southwest corner of the intersection of Evans Avenue and Third Street. <br />COUNCILMAN TOTH MOVED TO APPROVE THE PRELIMINARY PLAT SUBMITTED BY MR. GENE KREUSER <br />FOR THE PROPERTY LOCATED IN THE SOUTHWEST CORNER OF THE INTERSECTION OF EVANS <br />AVENUE AND THIRDST~EET. COUNCILMAN ENGSTROM SECONDED THE MOTION. THE MOTION <br />PASSED 3-0. <br /> <br />17. Greenhead Acres Third Addition Feasibility Report <br /> <br />The City Administrator indicated that the feasibility report completed by Con- <br />sulting Engineers Diversified was fOr the improvements in Greenhead Acres Third <br />Addition and further indicated that the City has executed a developer's agreement <br />with Mr. Lloyd Anderson for the improvements in Greenhead Acres Third Addition. <br />Councilman Toth expressed his concern regarding the City selling bonds. for devel- <br />opment projects. The City Administrator indicated that the City is not obligated <br />to sell bonds for every developer and that they have the authority to review each <br />developer and development and determine if it is beneficial to the City. COUNCIL- <br />MAN TOTH MOVED TO ADOPT RESOLUTION 81~20APPROVING THE FEASIBILITY REPORT FOR THE <br />IMPROVEMENTS OF GREENHEAD ACRES THIRD ADDITION. COUNCILMAN SCHUDLT SECONDED THE <br />MOTION. THE MOTION PASSED 3-0. <br />COUNCILMAN TOTH MOVED TO APPROVE RESOLUTION 81-22 ORDERING THE PLANS AND SPECI- <br />FICATIONS AND THE ADVERTISEMENT FOR BIDS FOR THE IMPROVEMETNS IN THE GREENHEAD <br />ACRES THIRD ADDITION. COUNCILMAN SCHULDT SECONDED THE MOTION. THE MOTION PASSED <br />3-0. <br />
