Memo to Planning Commission/P 99-9 <br /> August 24, 1999 <br /> Page 3 <br /> • site amenity with a fountain detail maintained under the Homeowner Association. <br /> The second pond is located partially on Lots 13 and 14, Block 2, and partially in the <br /> park. Staff had recommended that the developer move the NURP pond all the way <br /> out of the park as possible to provide greater access through the park and to <br /> minimize associated tree loss. The Park and Recreation Commission concurred <br /> with staff's recommendation, however after discussion with the developer, staff is <br /> satisfied with the present location which is further out of the park while <br /> maintaining the function and general location of the pond (See the attached City <br /> Engineer's memo). <br /> Landscaping <br /> The Subdivision Ordinance requires one front yard tree and one street tree for each <br /> lot; two of each for corner lots. In addition, the developer previously spoke of <br /> screening rear lots (double fronted lots) adjacent County Road No. 1. No screening <br /> is shown on the site plans. Staff recommends that the double fronted lots be <br /> screened from County Road No. 1 and that a landscape easement be recorded with <br /> the County against these lots with the recording of the final plat. <br /> Homeowners Association <br /> In order to grade a road into the site from Landers Street NW, the developer will <br /> have to construct several retaining walls in the public right-of-way. Generally, the <br /> • City would not want structures in the right-of-way because of maintenance and <br /> liability concerns. The developer is proposing to have the homeowners association <br /> be responsible for maintenance and liability of the walls in the public right-of-way. <br /> This agreement will require the City Attorney's review and approval. <br /> Outlot A <br /> Outlot A contains 12.35 acres of which 8.5 acres is wetland, .35 acres is a NURP <br /> pond and wetland mitigation, and 3.48 acres of park. <br /> Park Dedication Requirements <br /> In 1998, The Park and Recreation Commission endorsed a park concept plan for <br /> Meadowvale Heights Park that incorporates additional park land to the north of the <br /> large wetland to create an improved "public" access to the park and to provide an <br /> opportunity for walkways around the wetland. <br /> In February 1999, a concept for Seven Oaks was presented to the Park and <br /> Recreation Commission for review and in general the concept was acceptable to the <br /> Commission contingent on the following criteria: <br /> • That the trail be installed as part of the development. <br /> • That the dedicated parkland be dry land with the trail on the dry land. <br /> • • That there be a 20 foot minimum distance maintained between the trail and <br /> back yard property lines. <br /> \\elkriver\sys\shrdoc\planning\stevewen\pcm mo\p99.9.doc <br />
